Hello Everyone!

Does anyone know any official document stating that you ok to come back to the States even if you were out for more than 1 year but on military orders?

My husband (active military) is stationed with me in Japan but soon we will have to come back to the States. We have been here for almost 2 years and I wonder

if I need any other proof than his orders to explain the reason why was I away from the States for more than 1 year.

Any experience in that topic?

Hello !! You can apply to expedite the USCIS process but it is VERY HARD to get it if its not a deployment. We tried already to expedite and they did not accept our petition so I wont think expedite is a posibility! But you can try! You have to call USCIS once you apply you have to give them your case number and they will give you a new case number of the expedite process.

Hope this helps!

Thanks P&T. I already asked them, but it's useless. The Mil helpline is even worse!

reg.ula.tion.me.ooow.2011 // tomcat.fight

to do list:
file i-130, petition for alien relative
get immigrant visa
get ssn card and green card
get employment authorization - not required
file I-751, petition to remove the conditions of residence (before 2nd year expires upon entry)
become a US citizen

Thank you Visajourney!

Hello everyone!

I am new here. But couldn't find info on my dilemma. Thought of putting this q in this thread.

I am from the Philippines. We are getting married here in a few months. My husband is based in Japan and will be until next year.

If by August 2012 we have everything we need for applying for an immigration visa, should I check the future interviewing process to be done in Japan or in Manila? I will be living in Japan by then, but will it be a problem for me or will it take us longer because Japan isn't my home country?

I hope someone can help with their knowledge. :)

Hi:

I did applied for VAWA and got approved. Were are you living right now? Please check the requirements for VAWA and if you have all the proof that USCIS required then file for VAWA. Make sure that they transfer the priority date from your approved I 130 so that way you don't have to wait that much. When I submitted my VAWA package I sent proof of good faith marriage, proof of abuse, and I don't remember but check the instructions for file for I360 on the USCIS website. I did the whole process with non profit organization.

Best of luck to you.

Hello!

Just found this thread for MilSpouses! I am from the U.K and my Husband is USAF. We had NO IDEA about the immigration process at all! According to his last duty station here in the U.K, all we needed to do was to get married and get on his orders!!! We all no that was a load of #######! Oh, but they had PLENTY of info for visas for U.S Spouses!

We got married in 2010, got orders for Hawaii, but they cancelled them because now he's married! Spent 1 year here then, got orders for Alaska in March 2011. In August 2011 he left for Alaksa... :crying:

We did file the petition twice here, but they sent it back twice for stupid reasons!

We had to wait for him to get a perm address until we could file it again!

I have seen him once, for 3 weeks..Which I am glad for, but it feels like there should be something out there for Military! :bonk:

It has been filed and we have been waiting for NOA2 since Nov 2011!

Anyway just needed to vent to others who understand!!

Good Luck..

The upside for you is that by the time you interview and do your POE, you will have had your 2nd wedding anniversary which means the IR1 so you'll be done. No need to remove conditions!
