Do I send the I-129F...if the NOA1 is lost in the mail??

Hi All!

Well....Just as quick as I got happy about FINALLY getting the Receipt Number.....I find out, the duplicate NOA1 could take up to a month to get here!?!?!?

~The check was cashed 01/23

~01/14 called USCIS and told them I had not received the NOA1

~Mr.Santos (Agent) gave me the receipt number and requested a duplicate NOA1

~02/21 called USCIS told them I still had not received it.....this is the bad part: Mr. Jones (agent) explained that when the previous agent requested it, it was done as an "e-mail" to the department that processes the NOA - that it could take up to 30 days!!!!

We waited for almost 90 days for the receipt number, and NOW because it got lost in the mail, it could take an ADDITIONAL 30 days?!?!?!?

Does anyone have any experience in this? Should I write in the cover letter the above situation, include the receipt number, and then send the I-129F packet anyway; without a copy of the NOA1??

I hope someone has some advice on this one.......this is totally killing me!!

You need I-130 NOA1 letter to send a copy of in with the I-129F for K-3

It has been reported many times that USCIS may be administratively closing the I-129F for K-3 visa due to faster processing of the I-130 through to immigrant CR-1 visa.

Compare timelines, for most, CR-1 only takes a bit longer. The big Plus of CR-1 is getting green-card upon entry, allowing Work, getting SSN, and even able to get driver's license. K-3 is NOT work auth, so cannot get SSN, JOB, or Drive, until getting EAD or Green-card, EAD take 90 days or more. And AOS costs $1010.
