Hi everyone..

Ok..so I got a rejection letter for my I485 packet based on my lawyer not sending the cheques in correctly..USCIS says it takes up to a month for the packet to come back so we can resend..Does anyone know if it actually takes a month? would I be better off to just redo everything and resubmit? did I mention my lawyer is apparently mildly deranged??lol

Yes- skip the lawyer, hoinestly there's nothing in this process that is needed...except that the lawyer likes a paycheque!

Havign a lawyer does appear to slow the process tho :)

I don't know how long it will take for the package to come back though.... but i'm sure other members will chip in with wiser words for you.

I'm so annoyed..you have no idea..I just don't get how she doesn't know this? she was filing 2 packets..one for me..one for my daughter..is if they're 2 cases..does it not make sense to send 2 cheques? and at the same time..can the uscis worker not add??lol..1010.+1010 is 2020...DUH!!haha

So the lawyer just sent in 1 cheque instead of 2. I would DEFINATELY either get a new lawyer (if you are really sure you want to use one) or just do it yourself.

When my Sister sent in her AOS for her Husband and Son, she sent separate cheques, we discussed it and decided that was the best route. The fact that your lawyer doesn't know this would indicate she knows less about the process than we do :lol:

Get rid of the lawyer. You need not hire someone to file papers for you. You can do this on your own and you can do it better.

I've already paid her..UGH..should I just resend on my own? I have such a headache right now!

I'm so sorry this happened to you! That's just terrible. I'm not sure how long it will take to get your package back...

I really hope that lawyer won't be billing you and when she does I hope you tell her to eat worms.

When my I-130 was rejected (for signing on the wrong line) I got the NOA-1 rejection notice along with the entire package in the same evelope. The NOA-1 was dated 1 week before it appeared in my mailbox, if that helps you at all.

lawyers dont make the process any faster. Really all they are in straigh forward cases are $$$ proof readers!! You stil have to gather al the documents and you have to mail her the info!!

We used a lawyer only because after my wife waited ALL day to speak to an immigration official (was before they had info pass appts),he said it was best to so!! Our lawyer was fine, but not worth the $2500 + filing fees!! Oh well , live and learn!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Yep. I signed the I-130 on the line that is for 'Person Completing the Form' rather than the Petioner line (which is directly above where I signed). I lost over 3 months of time since I originally filed Oct 2007 and didn't get the rejection until January 2008. I just received my NOA-1 for the resubmission and they generated a new case number for me so, I start over as if I had never filed in October.
