I currently live in the US.

i got my new H-1 visa last month. Meanwile, my I-485 case is pending.

Do i need to apply for advance parole in order to travel outside the country?

Also, i am under F2B (unmarried sons and daighters of permanent resident). it's been approved, but i havne't got a visa number yet. (this could take years)

i don't knwo what to do.

Hi there,

Welcome to VJ.com!

You've got quite a complicated situation there, haven't you! I thought I would reply because nobody else has yet - most of us here are dealing with fiance(e) or spouses' visas rather than work related ones, so it's unlikely we would have the answers you need.

However ... FWIW, I did do a quick Google and found out that H1 visa holders (as you probably know) can travel abroad without having to get 'Advance Parole' as long as the H1 visa is still valid. However, whether or not the AOS and F2B situations make a difference or not ... Well, IMHO you really need to get an expert - preferably official USCIS - response. You might try checking with an experienced immigration lawyer. (I believe some offer short initial consulations for free.) However, it would probably be best to go for an 'InfoPass' appointment at your local immigration office, or Email them if that's not possible, that way you should, with luck, get the definitive USCIS answers you need.

Good luck anyway and do keep us informed.

All the best.
