I-130 sent in, no reciept yet...

Timeline

Hi, our lawyer sent in our I-130's on Feb 9th 2008. I live in NY so he sent them to the Vermont center. This was the correct place to send them and not the chicago lockbox right? The package was recieved at the Vermont processing center on Feb12th.

We have not recieved a reciept yet. Can I call them to inquire on out case and see if they will give me some information now? Thanks -Rich

Chicago processes and forwards the petitions to either VSC or CSC for adjudication.

I have seen posts where petition sent to wrong address results in it being forwarded to the correct center.

Two separate post office box addresses (see below) have been established that correspond to the appropriate USCIS Service Center (either Vermont or California) that will process and adjudicate the petition. Although Form I-130 must be filed with the Chicago Lockbox, petitioners will receive receipt notices from either the Vermont or California Service Center.
Chicago will send the petition to VSC anyway, the only problem is if VSC will process the check, Chicago lock Box is the payment processing center.

And what are "stand alone" I-130 forms?
Stand alone means CR-1/IR-1 petitions (I-130 ONLY), K-3 petitions use I-130 and I-129F, and adjustment of status from another visa type used I-130 and I-485. Edited by YuAndDan

We did plan on filing for both CR-1 and K3. Is this why he sent the forms to Vermont?

Chicago Lock-box is handled in a bank, USCIS is working on streaming the system, and over time everything will be sent there so that they only have to maintain one money processing center.

Note: lately there have been many posts about USCIS dropping the I-129F (K-3) in favor of just doing CR-1.

CR-1 takes only a bit longer to process in most cases, and eliminates dealing with USCIS again to adjust status from a K-3.

K-3 is not work auth, so cannot get SSN, JOB, or driver's licenses until they either get Green-card, or EAD card. EAD takes 90 days or more to get.

Lawyers love K-3, for the added paper work and fees thay may charge. I-129F and later adjustment of status I-485.

Yes, I-130 goes to Chicago, and Chicago will send to VSC or CSC depending on where petitioner lives. Then after getting I-130 NOA1 letter, the petitioner then sends the I-129F package along with copy of I-130 NOA1 letter to the service center that Chicago sent the I-130 petition to.

Mail the I-130 Package to the USCIS

Effective December 3, 2007, all petitioners filing stand-alone Form I-130 are encouraged to submit their petitions to the Chicago Lockbox instead of a USCIS Service Center. I-130 petitions filed with the Chicago Lockbox will be routed to, and adjudicated at, the appropriate USCIS Service Center. This routing will be based on the petitioner’s place of residence in the United States. You will receive a notice in the mail indicating what Service Center your petition was routed to.

Mail I-129F Package

Section 12 of the I-129F instructions lists where you should mail the completed form(s). For a K-3 Visa you should send the I-129F to the Service Center where the the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

I filed I-130 for my wife 13 May 2007. Never heard a word from INS.

Called them mid august about status and case number.

Was told on back of check is the Case number use that to track.

Never heard from them again.

Checked website in January 2008 said case was approved.

That is the only info i ever got.

Did you move while the I-130 was being processed? USCIS mails most things "Return Service Requested" this results in correspondence returned to them NOT forwarded.

sometime lawyers don't know what they are doing.

since most members here in VJ do their own case, it fast and doesn't waste any money.

it only took me 2 weeks before i get a notice from USCIS.

remember all USCIS send to your physicall address it might get lost in the mail.

then i move everything to PO box and i get mail fine

I believe your package will be re-routed to Chicago lockbox for data entry and then re-forwarded to the respective processing center. So you may expect some delay there! Maybe it's about time to have a word with your lawyer for not keeping himself/herself updated!

By the way, you may need to wait for about a month before your check will be cleared and receiving your NOA1. We filed on 18/1 and still waiting for our NOA1.

My lawyer informed me that it was sent to Vermont Sevice center because it was sent FEDEX and must be signed for. Chicago lockbox is a PO Box, no one can sign for it. I am aware it will be forwarded to Chicago then to the correct center.

I had sent money orders not checks, so I am not sure how I will get a reciept number off the back of a money order... any thoughts?
