I wrote earlier about how I was fustrated that I never heard anything from immigrations about my 485 rfe that I tracked and sent back three and half weeks ago. When I called immigrations hotline yesterday they put me on hold for like the typical 15 minutes and told me basically that I could not complain about not recieving any online updates or letters from them until the standard 60 days has gone by--then they'll give your case special attention. Well, before I got to talk to a customer service representative the automatic phone system had me type my case number and they had a message say the following:

You need to submit the evidence that was requested. If you believe that you have already submitted the requested evidence please note that in your written response to the office.

I told the rep. that I had heard this message and she said that the phone system had more updated info then they had acess to, but said if you tracked it and know it got there not to worry about resending. She also told me to get the most updated info I would have to go to a local office infopass--when I checked online no appt. available ah.

When I checked my online status today it said the AP and EAD were aproved. So I am thinking that's good news right. Then when I call the hotline again they say the EAD and AP can get aproved without the additional evidence that those are seperate cases.

However, on my rfe (485) letter it said

this service will pocess your EAD I-765 within 90 days of reciept of your missing I-485 intial evidence.

So should I still be worried about them processing my sent in add. evidences and receiving no updates or notices, even though I tracked them and know they got there and the Ead and AP got approved? Should I resend my evidences like the automatic : messages still say on immig. hotline? ahh

please help anybody had this experience?:hehe:

Thanks :help:

Ugh... I am worried about the same thing now since there are no updates on them receiving my RFE either. I'm seriously considering now just going ahead and doing the medical again... but actually I think maybe I'll contact my congressman rep first and see if she can find out if they've finally received it. I'm not sure what to do about sending a new RFE because we already sent the official blue paper for an RFE. 60 days is not fair... since they only give us about that amount of time to answer the RFE and will probably deny the case if they don't have the stuff!!! Oh, you can probably try contacting your congressman if you are worried!

Yeah, the sixty day wait is fustrating. So you guys got your ap and ead without the rfe on the 485 affecting those.

Do you remember on your rfe letter if it said they would not process the ead until the evidences were sent in withing ninety

days of reciept of your rfe? Because maybe they have looked at your sent in medical if they gave you the ead? What do you think?

Nope, the EAD and AP were approved before we returned the RFE. I think they were done totally separately... actually I think they may have been done at separate offices. For some reason I'm thinking the EAD and AP applications stayed at the National Benefits Center but the I-485 was transferred to California on its own.
