Hi

I have a question for a friend. She is a permanent resident of the USA and been in this country since she has been around 7. I would like to find out if she must become a USC prior to filing for the K1. Does anyone know

2/1/2010- AOS , EAD. AP Mailed via USPS priority mail

2/3/2010- Received - via USPS delivery tracking

2/9/2010- Check Cashed

2/9/2010- NOA 1 Received for 131, 765, 485

2/17/2010- Received letter for biometrics

2/19/2010- Completed biometrics via early "walk in'

2/22/2010- Touched on I-765, 48

2/24/2010- Case transferred to CSC

4/2/2010 Card Production Ordered for I-765, AP touched (Yea!!)

4/8/10- Approval notice for I-765 sent via email/ AP touched

4/10/2010 Received AP.

4/12/10 Received EAD-

7/6/10 Contacted USCIS because now Outside normal processing time

7/23/10 Got RFE asking for proof of legitimate marriage- 1page and 1/4 of proofs

8/23/10 sent off RFE response via Expressmail

8/24/10 Received by CSC

9/2/10 Email from USCIS- Card Production Ordered

Latest news: Green card received 16 April 2007. USCIS-free until 3 January 2009! Eligible to naturalize 3 April 2010.

No, a K1 and K3 are only available to US Citizens to file not a permanent resident. She absolutely must become a citizen before she can file for her fiance. Pax is mistaken. You can check USCIS to see the same.

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

Pax wasn't mistaken. The question was "Must my fiance become a USC first?". Pax responded "yes".

Aren't CR-1's available to spouses of LPR's?

Sorry, I should have been more specific--yes, your friend needs to be a USC first.

LPRs can, indeed, file for spouses, but the wait is SO long--you're much better off doing the naturalization and then doing a K-1.

Maybe even Pax was only answering the second question that in fact someone does know.

No chance of your friend applying for citizenship? The natz process is faster than a lot of people think--12/18 months at the outside.

She has been here that long, but she is not a Naturilzed Citizen, something about her mom not applying for some reason. I would advice her to definatly do the citizenship thing first, though
