Hello Everyone,

I noticed Visa Journey recently updated the I-129 guide advising us to include an I-130 transfer notice (regarding the Chicago lockbox to the local Service Center). I did not receive a notice and am not sure if this is something I need to include. I just received my first NOA (Yay!) and need to mail the I-129 asap.

The best information we have now, IMO is not to send the I-129F. Nobody who filed an I-129F for spouse after July 28, 2007 has had any I-129F approval. The petitions are being married up, delaying the I-130 processing. When the I-130 is approved, the I-129F is administratively cancelled. In effect, until this policy changes, there is no K3 visa for those filing after July 28, 2007.

I would not file an I-129F for spouse at this time.

If there are children involved for which you wish a K3 visa, apparently that is dead too, so they need their own I-130 filed ASAP if not done at the same time as the immigrant parent's I-130.

The above statements are supported only by consistent and very specific anecdotal reports. As of today, no official communication from USCIS has been found to verify the new policy, so buyer beware.

My I-129F was paired up with my I-130 and eventually cancelled. It delayed my I-130 approval considerably because they took the I-129F NOA1, which was filed 1 1/2 month later, as the priority date.

If I had to do it all over again, I would not file a I-129F. Just my opinion of course.

There's sooo many of us here on VJ that had our K3s closed. I really wonder why USCIS doesnt want to make an official statement. It will save a lot of people a lot of grief.
