I have been comparing the timelines of the K-3 NOA2s vs. the NOA2s of the IR1/CR1 and the K-3 visa approvals have been stuck in early July for some time now. The IR1/CR1 approvals have moved into September. What is going on? Are they putting us on hold until they realize what will become of the K-3 visa? Not knowing what is going on is driving me crazy! I called USCIS where they know nothing and wrote my senators who just promise to further investigate. Can we get some answers please?

Visa Journey:

Marriage: July 6, 2007

I-130 Sent: August 7, 2007

NOA1: September 24, 2007

I-129F Sent: September 25, 2007

NOA1: October 9, 2007

NOA2: March 7, 2008

Packet 3: March 28, 2008

Interview: June 24, 2008

AP: June 24, 2008

It has been posted many times, that USCIS has been administratively closing K-3 in favor of the Superior CR-1, they have been stating that CR-1 has been processing quickly lately and the need for K-3 is not an issue.

CR-1 is the superior visa anyway, it results in a Green-card upon entry. K-3 requires AOS ($1010) additional USCIS processing, and is not work auth, so cannot get a JOB, SSN, or Driver's licenses until filing for and receiving EAD or Green-card, EAD takes 90 days or more to get.

Okay--but are they not processing our I-130 applications since we filed for K-3? Why are the dates so far behind the people who filed for I-130 only?

They will continue processing the I-130, but from many posts lately it sounds like the I-129F, is being held and I-130 is being sent on to NVC for CR-1 or IR-1 Immigrant visa.

I have noticed that people are stating the the K-3 are being closed as a matter of fact. In other threads, it sounds like the people who are calling are kind of getting that impression but nothing concrete. I think at this point no one knows. Other websites do show some approvals for August for I-130 and I-129F.

Of course CR-1 is better but people aren't trying to get a K-3 for the fun of it or because of their desire to pay more. Up until recently, it was a lot faster to obtain. Per VJ, it's approximately 1 month for NVC to forward to the consulate and 2 months for the consulate to give your K-3 interview. This is in comparison for CRI: NVC - 5 months and 8-12 more months to get your appointment at the consulate.

Many who are have not been waiting years for their spouses may not mind the difference. I have been waiting for a few years and it make a HUGE difference to me.

Hello all. I filed my I-130 back in May 2007, and the I-129F (for K-3) back in early July 2007. I got my I-130 approved on August 27, 2007, and just a week and a half ago I received a notice from USCIS that my I-129F (K-3) has been approved and will be forwarded to NVC for processing. So today (Feb 19) I got another notice (from NVC) stating that they will forward my petition for K-3 to the consulate, and within 1 week the foreign consulate will send my wife a packet explaining what documents they will be needing from her etc...

Now what's interesting is that my wife has already had her interview over 2 weeks ago, and now we have 221(g) requesting more information (proof of relationship), so that CR-1 Visa app. is on hold pending them receiving more information/docs from us....

So I am puzzled at this point - we are nearly at the end of the road (hopefully) and about to get the CR-1 Visa for my wife, and now this late in the game they are sending K-3 approval to Embassy for processing etc...do you guys in here think this will complicate my case, will the Embassy get confused and perhaps hold off issuing the Visa to my wife, when they see this K-3 paperwork arrive from the states??

Anyway, I hope that this information perataining to my case is helpful and can shed some light on some of the questions in here, and I hope someone can also advise me as to the potential confusion/complications my case may see due to this dual CR-1/K-3 situation..

Please advise.

When we (K3 filers) sent our I-129F's in, USCIS pulled the I-130 and paired the two together setting both forms to the back of the line at the time of pairing apparently. In essence, filing for a K3 has actually DELAYED our petitions beyond that of what just filing for an IR1/CR1 off the bat would have yielded. So you see people who had never filed 129F's getting approvals months earlier because their I130's were never pulled to be paired to 129F's. Now that 129F's are being administratively canceled, you end up with an IR1/CR1 anyway, but it ends up taking months longer rather than being quicker!

Well put Badspeller! That's EXACTLY what's happening & there's only a handful of us that are in this predicament! It hasn't been 180 days yet so none of us can even phone to find out what's happening! Talk about frustrating as hell...we're in limbo & they're just biding their time. I say "just approve us for one or the other & let's MOVE!!" I've got a 4-6 month wait for an interview in Montreal PLUS have to send in an I-130 app for my son & WAIT AGAIN for it to catch up!

And I always thought the K-3 people were favored, My CR-1 wasn't favored as long as it took to get an interview. Take a look at my time-line... Superior as you say... I didn't get superior treatment.... I pray your case moves along quickly... I know you are anxious to be with your spouse so am I....We all are...

I am so frustrated!!! It has definitely added more time to our cases and the worst thing is that USCIS does not even admit it's happening. I called using the RFE trick and the rep told me I was still 6 weeks from being out of status but that my I-129 was still open and being processed.

So what do you guys think I should do at this point? The CR-1 is getting complilcated since everytime my wife goes to the embassy and submits what they are asking for (proof of relationship etc), they ask for more stuff and tell her to come back in 3 weeks, so they are not issuing the Visa - but the K-3 is probably arrived there at the Embassy now, so will they go forward with that, will that cut our time shorter and improve my wife's chances of at least coming over here while they dilly-dally with her CR-1 Visa??

Or would I have to call somewhere and actually cancel the K-3 application? In order to reduce confusion??

Please advise.
