I have read numerouns people have got married, got there SSN then applied for AOS on a k1 visa. Firstly, how exactly do i do this? what exact documents do i need to take in? When i was in the office i got told i either had to have a work permit or a green card to get one.

Secondly, what is the point in getting a SSN before the EAD arrives as can't you not use it anyway?

SSN's are needed for lots of reasons - to open bank accounts, get on your spouse's health insurance, and to establish credit. Depending on the state, you might need an SSN to get a driver's license. You'll probably want to get a jump on things like that before you can work.

If you arrive on a K1 visa you can apply for a SSN at anytime upto 2 weeks before the expiry date on your I-94.... if you have not applied and received the SSN by the 76th day from arrival then you will have to wait until you have either a EAD or a Greencard to get a SSN....

SSN can be needed to open bank accounts, be added to medical insurance & car insurance, to get a State Drivers licence or State ID card. there are many many thing where you will need a SSN...

hi thanks for your replies, but i sent in my I-94 when applying for my I-485! Does this mean i do in fact have to wait now until i get my EAD??

I think you were only supposed to send a copy.

15. Evidence of eligibility.

B. Based on admission as the K-1 fiancé(e) of a U. S.citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate and your Form 1-94.

you were only meant to send in a photocopy of your I-94 the original should have remained in your passport.... you have no choice but way for your EAD or Greencard....

I agree it's poorly written, but without the I-94 you are screwed until the EAD card is received. Next time ask someone here, rather than calling the misinformation line.

What's so crazy about the whole SSN thingy is...a K-1 holder can apply for SSN prior to I-94 expiration (90 days) without a greencard or EAD, BUT a K-3 holder, which is valid for 2 years, CAN NOT APPLY for SSN without the greencard or the EAD. Sucks!

SSA made an exception for K-1s because of the time limit. K-1s can applied for EADs under the A6 category and INS was having trouble getting them out to people before the 90 days was up, so SSA made the exception. K-3s have no problem with status expiring before the EAD is issued.
