How to Shake Your NOA2 Loose from the CSC

(Apologies for encroaching on Mox) To the immigration people, "expedite" is for Cuban applications, emergency asylum applications, military applications, and (only for the very few) TRULY emergent personal circumstances (life-or-death matters, if even those!). Mox may have a more complete explanation.

Why would a military application be expedited over any others?

Impending deployment.

Would it be worthy of me applying this method now? I am almost 3 months into the wait and people from the VSC who sent in their petitions around my time (December) are already getting approved.

Do you have an RFE?

The officers are there to assist those with a question about an RFE.

Nope, no RFE, just a lot of waiting time. Oh well, I should just grind it out like you have to do sometimes in life.

If it's been 3 months and you're wondering, I recommend that you call. Depending on what you learn, you could make a mental note to call again in 4 to 6 weeks. For now, you will feel better once you dispel the uncertainty of "not knowing." You will learn nothing more than you know now if you resort to the usual method of waiting 30+ minutes on hold only to speak with a front-line screener.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

TB, he's a CSC filer, who are averaging about 5 months. He's only been waiting for 2 months. If there really is a good time to call, I would have to say in all fairness that this really isn't the time. His petition is currently in a box in a warehouse right now, nowhere close to an adjudicator. It's one thing to call if people are being approved around you, but no December CSC filers have even been close to approved yet.

Keep in mind that they record every time you call, and there is anecdotal evidence that the more you call, the less likely they are to help. If in fact the poster is resolved in calling, he would be well advised to "save" these calls for a later time, when a successful outcome would be more likely.

Mox's points are well-taken. Add those to your thought processes, Dave. Nothing prevents you from making a call of inquiry, though; it's your right to do so. The thing is, unless you do call, there's no certainty whether your file is in a box on a shelf or somewhere else.

TB...you know I love ya man, but I wish you'd re-think this advice. I don't think it's a responsible position to take. I'm all for using the system to get answers when things are looking bad, but this particular instance has a 99% chance of failure and possibly impacts future calls for the petitioner. It simply doesn't make sense yet for this filer to call.

OK, then: Dave, considering the reasoning presented, it's probably better that you wait awhile before inquiring.

Correct me if i'm wrong but they went through the bulk of september in about 3 weeks. In theory for every month that goes by CSC moves ahead by one week? Sooooo... if the average sept filer waited 5 months then January Filers will likely wait 4 months. So Dave I'd say you've got at least until April 1st. If I were you I'd wait until April 15th or so before you give it a try, or at least until you start seeing December filers approved.

Even in my position, i'm not going to use it even though i finally got the NOA1 for fear that they may jak up my file.
