I should rephrase-its the only answer your getting that does not advise you to violate clearly stated guidelines to using the USCIS system!

Anyone at USCIS questioning your use of any method to get information to which you are entitled is to be told "Despite the fearful admonitions of Mike-Mely, I am exercising my right under the First Amendment of the U.S. Constitution to petition my government for redress of grievances."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

And what do you base this guidiance on? Your personal experince or your opinon - and if it is your opinion, what are you basing your opinion in??

You're a mid-October filer. Under the First Amendment, it is reasonable for you to make the call to USCIS to find out.

Are you a Constitutional Law graduate now, TBone?

You do realize that's a specialty, don't you?

Honestly...this is unnecessary. Nothing productive gets done when tempers flare.

I sincerely don't get this. Some people think they should be able to call USCIS at their whim to make themselves feel better. Others disagree with the tactic.

To turn that into some sort of Constitutional debate is, frankly, silly.

I don't know enough about Constitutional law to know if TBone's argument holds water or not (the vibe I'm getting from resident legal expert rebeccajo seems to indicate it's dubious at best, but I don't want to put words in her mouth), but I do agree with his sentiment that government needs to be a lot better at serving the people. This crosses just about every government service there is, but for the purposes of this discussion we're focusing on USCIS, specifically as pertains to VJ membership. So to that extent, I agree with TB that we should be demanding better service from USCIS. Is it "redressable?" I have no idea.

I don't think anyone disagrees about USCIS not serving us better.

What's scary, though, is they're actually a lot better than they used to be! :lol:

Some of the problem is that some of us have been waiting six and seven months.......with no contact about what is going on......it eats at us and gets on our nerves..........but in reality the biggest problem is the system that does not answer any questions about our applications........and if they do depending on when u call if u have the need to call again u get a complete different answer than u did the first time .......... the system needs to be changed and made family friendly.....they increased our fees for applications to hire people so that cases could be dealt with better.......how ever when u have jan and dec people getting approvals while aug sept and even some july people are still waiting.......well as u can see tempers rise....from what i can see the system by passes many constitutional rights that citizens of the usa have.....but us getting into a fight over it is not going to change anything we should remember to always be polite and kind to each other we are here to support each other and give each other strength......a support system that in some cases is all that some people have while going thru this insane night mare that has turned wonderful loving people into bewildered zombies......

Exactly.

Because it isn't about that.

It's about whether or not what one does - to make oneself feel better - can impact the entire system.

Apparently there aren't a load of these 'immigration officers' available to take calls. If there were, one wouldn't have to go fiddling about through the prompts to get to one. At the present time, USCIS sees fit to limit the access of customers to the IO's by filters in the recorded questions.

That ought to tell everybody something. Like - if the lines are clogged up by people trying to make themselves 'feel better' - what about the poor folks with a REAL problem? How would you like to be sitting there with a piece of paper in your hand that makes you feel like your entire case hangs in the balance, and you can't get through to a LIVE person because the lines are jammed?

I say using this line, when you are still inside the published processing times, is flat out irresponsible and smacks of entitlement.

I gotta say I agree with this 100%.

Since we all do have each other, why can't that be enough support for people? I mean - if you can clearly see there are others around you who are not approved yet - why do you only choose to see the people who HAVE been approved?

Does that make sense?
