Today i am having such a hard time with emotions ........frustrated.......irritated.......childish........i contacted our attorney yesterday this was his answer :

Hello,

It does still show pending as you noted....according to USCIS

guidelines they are still processing applications with a receipt date

of

July 19th; they wont do a manual check or consider anything wrong until

that day has past. Some people will get their NOA 2's much faster...I

have client who have gotten them who filed in Oct...however its not

consistant and there are others in the same boat as you....the decision

will come...

I think if we do not get NOA2 by spring break i am going to use my spring break to go and see my finance we are both getting really frustrated over a year since we have seen each other ...... sorry just venting

I don't think the lawyer is going to be able to give you any more information than what you could get by calling USCIS yourself.

Just hang in there. It will all be over soon.

I know we have not been waiting near as long as some of the rest of you .......but i guess i expected something a little more from our attorney than an answer that i could have gotten from calling the California's hot line

Here is what I did to shake things loose. The keys are to [1] reach a correct person, and [2] speak USCIS's language.

Call 800-375-5283, then hit 1,2,2,4,2,1; enter your receipt number; hit 1,1. The recording will almost certainly say that "additional evidence is required," but don't believe it. When the phone rings, you should be speaking with an actual Immigration Officer (not a clueless front-line idiot). Ask the ImmOff exactly this: "Why does the recording say that I have a Request For Evidence?" He/she will almost certainly tell you that there's no record of an RFE; thank him/her profusely. Then, ask exactly this: "Will you please tell me exactly where in the Division my file is?" He/she will tell you. Then say exactly this: "I'm aware that several files received after mine have already been approved, and the USCIS website clearly says 'we process applications in the order we receive them.' Will you please send an e-mail to the floor, and ask the person at the ____ station [whatever the ImmOff told you] to please hand-carry the file to the next station?"

This will at least cause one of the processors on the floor to handle your file, and the website may soon register a "touch." It is worth it, and you should feel better afterwards. Depending on how recently you have submitted your application, you can repeat this process every 10 to 14 days.

Let us know how it works for you. I'm tempted to submit the above as a fresh thread in hopes that it will be "pinned" by VJ.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

:) thanks i going to try it i our NOA1 was sept 24th and i have never ever bothered them so I will give it a try thank you so much even if it does not generate anything i will have at least talked to a person :) :)

Why don't you set up an account at USCIS website for email notification. Then you will know if you have been touched(dates will change if they are working on your case) They will send an email when you get approved, you will know before your lawyer. You really don't have to call him, just check your A/C, getting touched is very exciting :yes::yes:

Why don't you set up an account at USCIS website for email notification. Then you will know if you have been touched(dates will change if they are working on your case) They will send an email when you get approved, you will know before your lawyer. You really don't have to call him, just check your A/C, getting touched is very exciting :yes::yes:

Hi, thanks i did set up as soon as we received the NOA1 on the 24th of sept... we have been touched only once in all the time we have been waiting and that i believe was on the 7th of this month.......and they did not send an email of any kind, we are set up for email too......anyway i am now going to try what T Bone said and lets see what happens i will be praying thru it all hoping against hope for an good answer :)

I was pretty excited about NOA2 and know the wait stinks, however for my Chinese fiancee we're probably going to wait about 5-7 months before NOA2 and Packet3.

Then we have the possibility of even more delays. This process is not easy, fast, convenient, or good for stress, but you have to just spend the time productively and try your best to grow closer as a couple.

I got a really nice lady

she asked for my receite number what kind of visa i applied for and my name.......she then said we are processing Aug at this time then she said wait a minute ......mmm I am going to send a email to find out where this is in the system why it is taking soooooo long give me ur phone number and i will get back to u (dont know if she will buttt????).....then said said happy birthday on fri..... and repeated my phone number back to me....

and she was LATINA.......so is this good or not????

at least i feel a little better as you said i would

Your file may have been sitting at a "transit station" (between actual desks) or anywhere. Do not expect a call back; try again in one week if you haven't heard. Feliz cumpleanos, and ANY Latina es buena (and usually also muy hermosa), si! :)
