I-129F Petition for K1 visa. Will her child get visa too?

Hello Everyone,

This is my first post on this website. My question is regarding my fiances 10 year old son. She was married to the boy's father and divorced him 3 years ago. I included her son's information on LINE 13 of the I-129F petition. I also included a letter that states that she has full custody of her son. So, do I need to do anything more to insure that her son can come with her when her K1 is approved? Will the boy get a K2 or K4 automatically? She will not leave Russia without her son and I would not want her to leave him either. He is only 10 years old and can not fend for himself. She is concerned that I have done something wrong. Please help...

I'm not a Russian lawyer, but I play one on TV... :lol: But seriously.... You would need to make sure of the family law practices and policies of Russia. If it is anything like Philippines, the mother generally has near absolute responsibility of the children, except when it suits a wealthy, vindictive father to play spoiler. I wish I could point you to a website that might have that information, but you might consider googling Russian Family Custody Law. Generally speaking, the US Embassy doesn't "care" that you are bringing the child of your fiancee. But, airlines might, and Russian boarder agents might. Get your ducks in a row, have all the papers you need.

20 Jun 2008 - Filed AOS, EAD

CONFIRMED Baby due 18 Apr 2009 - Two years from meeting.

5 Nov 2008 - K-2 Visa for child @ USEM

The boy will have to attend the interview in Moscow, and documentation will need to be presented to show that the father is giving permission for the boy to leave the country. This can sometimes be difficult to get and may be used as a tool by the father to make things difficult for the ex wife or to extort money.

Thank you for the response. Do I need to file any more documents or is my I-129F petition that has my fiances info and also her son's info enough? Do I need to file separate forms so the boy will get a visa too? Sorry, I did not make myself clear in my first post.

for the packet that your fiance will put together your also gonna need a seperate packet for each child. ds156,ds156k, affidavit of support. check on the embassy site that the interview will be at to make sure what they require since each one has a different procedure that varies from country to country. our interview is in mexico in april and we assembled an identical packet for the daughter. also..since its a seperate visa that the child will recieve they will also have their own set of fees for the visa, and medical exam. good luck.

Thank you all very much for your answers. It appears that I have done everything correctly then. You would not believe the email that I received from my fiance when she thought that I had excluded her son from getting a visa! I was hoping that I had not missed an important step in this process.
