My lawyer He told me that he doesn't really file for k-3 anymore cause it is not really any faster. But I expressed to him that we wanted the faster way due to our circumstances. He told me that he would file for both visas and which ever gets approved first that is the way we will go. He did say that the GOV. is sometimes twisting up the two processes and is ending up taking longer in the end. He had me fill out I-130's and I-129f's for both my wife and her 7 year old daughter.

The papers were sent on Feb 9th 2008. I assume only the I-130's were sent but I need to call him and ask.

My question is, can he even file for both k-3 and cr-1 visas? And if so, would he have sent in both forms now if we were going to file for both visas? Or after the I-130, send in the I-129f to start the k3 ALONG with the cr-1... can some one clear thie up for me so I can sleep tonight? lol -Rich

Mountain...it seems that filing for I-129F is holding things up for those of us that applied for both after July 30, 2007. Hindsight is 20/20 and if I was doing it all over again, I would've only applied for the I-130 for myself and my son and left it at that. I now find out that thru the Montreal consulate, I can beg them for an earlier interview date so that my son gets into school at the start of their school year! You may need someone from Columbia to answer you. Good luck!

Hello Mountain,

Much discussion on this issue - and but of course - we all want our other half here asap - but it seems to be the new hitch at USCIS - the I130 will go first (filing) - maybe the lawyer will send the I129f with it, but its debatable which service center you will end up - so that may cause a small delay in your I129f since the I130 goes to Chicago Lockbox technically. The I129f should be sent to the service center that is processing your case but again it can work out to be on the opposite coast - even THOUGH the website for USCIS says if per se, you are in Florida ok send to Chicago and then you should be sectioned out to CSC - that did not apply for alot of us a few months back and we ended up in VSC. So again, if you paid the lawyer and you are well represented - well what can I say but always stay active even tho they do the paperwork, you can always monitor your own case.

It does seem that the I129f is getting cancelled on some people now, but its not legal facts on USCIS YET....but I do believe they are implementing the procedure according to the other threads and from my conversation with Omsbdmn rep last week -

Side bar tho - We did both, and not sure which one will get through first although our timeframe was not a good one - but it seems to be getting better for filers now.

NVC JOURNEY BEGINS

4/07 NV Case number assigned

4/08 AOS, DS and all fees paid online

6/09 tax transcript for 2007 just became available -whoot

6/20 NVC receives everything nothing more to give them now just close eyes and pray

6/23 NVC enters into system

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET
