Hi all,

I'm new to this CR1 forum although I've been around on the K-3 forum for a while. We just found out that along with many others, our K-3 petition is being canceled and we are being forced to go with a CR-1. I am not too happy about this, but their seems to be no option. I've heard all the arguments about why the CR1 is a better visa, but none really matter to me. My wife will not be working when she gets here and the additional cost and hassle of AOS is immaterial if I could get her here just one month earlier.

In any case, I have read the CR-1 guide and need to know where I can get the latest versions of the OF-169, OF-230 and I-864 forms in PDF. If possible, I would like to have these ready once our case goes to NVC.

How did you find out that your K3 was being canceled - I know that ours was touched yesterday also and yes the I130 has been there for awhile but not in system, so I thought maybe they were just checking to see if there was an I130 pending and maybe going to bin the I129f.

When I spoke to Omsbdmn rep last week, she did say to me, even though its not written in stone, that they are trying to sort this issue out, but again - who knows what when where etc.

Curious tho about the cancel of the I129f - I would personally prefer to go the I130 route - but that is my personal preference and since the timelines are not that much off, not a big deal - but will take what is given of course.

The last two people with whom I've spoken at CSC have told me that all K-3 cases with a NOA1 date after 7/30/2007 are being canceled. I really hope they don't as CR1s seem to take longer to get from CSC to NVC to the embassy, but I want to be prepared for either eventuality.

I did my best to organize all the NVC processing and the shortcuts (if you care to use them) into one page here on vj wiki.

Check this link out. I think it will walk you thru what needs to be ready when, and get you thru nvc as fast as possible.

You don't have to use the shortcuts, but you can prepare all the forms ahead of time anyway.

Welcome on CR/IR forum :). Our K3 was cancelled as well and we also didn't care about AOS or my ability to work but uscis decided otherwise.

As for now

I can really recommend using JAMES' shorcuts - they really save time. They work for us.

As for latest version of documents - I think the best is official Department Of State page.

This really sucks. I noticed you got an RFE from NVC. It's bad enough we have to wait through the slow USCIS process, now with this CR1, we have to go through another round of BS at NVC. All the while, H1B non-citizen/ non-resident workers get their spouses here in a month or two. Someone should be fired and go to prison for those kinds of unfair and ridiculous policies.

I noticed you got an RFE from NVC.

Actually it might be a "false" RFE.

When NVC has reviewed I-864, automated system tels is RFE but really they waiting for DS 230 packet to enter the system. I ask my husband to send another DS230 because I made mistake. I left blank spot in q.20. I will call tomorrow.

Did you get a letter asking for your DS230 before you had a chance to send it in? If so I was wondering if you responded to the letter? I received one and just sent in the DS230 with my supporting documents. It doesn't seem like I needed to answer the request for the DS230 since I was sending it in anyway. (Does my question make sense?) Thanks.

Well the thing is we are using James' shortcut so the next day after form DS230 was GENERATED my husband sent everything. He hasn't received actual letter asking for forms as of today (02.21).

We learned about RFE by automated systemon 02.16. I called on tuesday and I've been told after I-864 was completed, they "mising" DS230 packet and RFE letter was sent on 02.15. So it was "false" RFE, we had not have chance sent it by then. Just like you.

Yesterday DS230 entered into system(per operator) and I'm waiting for saturday update to hear this.

OK. My answer is like a maze but do you feel I have kind of answered for your question?

Ok, I am not sure if this has happened to someone else, but I just called the NVC hot line this morning and found that my wife's and daughter's DS-230 paperwork got RFE'd. I been reading the posts and it seems that this may be due to a new requirement of two passport photo that needed to be submitted.

This requirement is not stated on the NVC website, which I can confirm. There is a requirement to sent a copy of the passport page with biographical info and any history of travel, but nothing about actually sending photos.

I am not sure why my wife's application was stopped yet, Have to wait for the letter, but if you are at the same stage where you are sending the DS-230 in, you may want to include 2 passport photos with the names of the petitioner and applicant and NVC case number on the back just to be safe.

CR1 is a better route in a sense that no AOS is needed after arrival in USA. You can find DS 230, I-864 at the NVC website (Dept of State) which you can find from NVC forum. OF 169 is no longer needed.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

For those of you that paid for the I-129F & had it "administratively closed", if I were you, I'd be making a stink about it in a big way! That is YOUR RIGHT, to have a CHOICE as to which visa route to go! How can they get away with this if you PAID for that option??
