My wife and I have been married for two years, we have one child, and because of our daughter we want to move to the US. Currently we are both working in Nigeria but wife is Spanish, I don't really know anything about anything when it comes to this, but the short and long of it is that now we want to move to the US so we are wondering what we would need to do in order to move, what sort of visa she would need, etc... also our daughter has was born in Spain and doesn't have an american passport. Something to ad is that my wife isnt intrested in becoming American we just want to live there, so she justs needs the right to reside in the US. Thanks

If you have been living as a resident in foreign country as a resident for more than 6 months then file the I-130 directly to the US consulate in the foreign country (DCF) this is the quickest way to get a visa. Filing I-130 and later I-129F for K-3 to USCIS in the USA will result in a much longer visa process.

Also lately many have reported USCIS droping the I-129F for K-3 and just processing I-130 for CR-1 or IR-1, this results in the superior immigrant GREEN-Card visa, not the NON-Immigrant K-3 visa. K-3 has the added head-ache of adjustment of status in the USA, K-3 is not work auth, so has to wait 90 days or more to get a JOB, SSN, and driver's license.

You can register your child's birth with the US consulate and apply for a US passport for her.

Give the nearest US consulate a call, see whether you can do a DCF (Direct Consulate Filing), that's the quickest way to bring your wife back to the US.

We made the mistake of not doing that and have to go through long process filing I-130 and possibly I-129F, which currently can take more than a year.

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

Last I checked, Nigeria's consulate (Lagos) does not do DCF. Also, it is my understanding that if a person files for a K3 (in america) they would have to go thru the consulate in the country in which they were married, as well as have an american address. Where were you married? I don't know any other options, sorry :(
