Will k4 visa slow down marriage visa process?

We just sent in our I-130 on Feb. 9th. not sure if our lawyer will apply for k-3 or CR-1 marriage visa. My wife has a daugter that we must apply for a K4 visa. Will this make this whole process take longer?

NO, No additional paper work needed, this is handled at the consulate. Later when adjusting status from K-4, an I-130 will need to be filed if one was not filed initialy when filing for wife's CR-1 visa.

Note, lately many have been reporting USCIS dropping the I-129F petition for K-3 in favor of the CR-1.

Lawyers LOVE K-Visas, they can charge more for filling out the I-129F, and later hope to charge more to adjust status from the K-Visa to get green card. Adjusting status costs $1010 + $600 for child.

CR-1 is the superior visa, it results in green-card, and NO adjustment of status. K-3 and K-4 are not work auth, so cannot get SSN, JOB, or Driver's license until after they apply for and receive EAD and or Green-Card, EAD takes 90 days or more to get.

Lastly compare CR-1 to K-3, you may see that CR-1 takes only a little longer for your country. CR-1 is filing I-130 only for spouse and I-130 for child.

YuAndDan, Thank you for the information. My lawyer had told me that he doesn't really file the K-3 anymore for the same reasons. But would choose the faster way to go just because we told him we need to go the fastest way we could. I think I will tell him that we will pass on filing the I-129f.

We have an issuse maybe you might be able to address... the biological father is refusing to sign the papers needed to take my wife's daughter out from Colombia. You can read my comments on my first post 'Hi everyone' we are not sure what to do about this situation. Maybe you or somebody has some advise about this? Thanks -Rich

The big alert is that the daughter will need her own I-130 for a CR2 visa, so that needs to be filed concurrently with the mother's petition. If not, no disaster, just a need to delay mom until daughter catches up.

I too would recommend forgetting the K3 and K4. It will just slow things down and end up cancelled in favor of the I-130/CR1 route anyway.

If I were you, I'd get the daughter's I-130 filed ASAP. You've got some months to resolve things with the father if you can.

We did file I-130's for both my wife and her daughter. We will not bother file the I-129's.
