3 years tax returns for I-864

Ok... so I am sponsoring my husband and we've just been informed that our interview date is set for March 3 (two weeks away!!)

We have been living in BR for more than a year and during this time I've been unemployed. So technically I don't have any income so I don't have to file taxes come this April. Since it hasn't quite gotten to be the time to file taxes, would would I need to provide copies of 3 years of tax statements that have been filed (in this case from 2006, 2005, 2004?) or would I count 2007, 2006, 2005, where for 2007 I would write a letter saying that I have been unemployed. Is it necessary to provide the previous years tax statements? The question 25 on form I-864 says "I have filed for the last three years and am including a photocopy/transcript of only the most recent tax year". How does this get interpreted?

We have a joint sponsor, so actual finances is not an issue, I'm more concerned about providing all of the documents that I'm responsible for, even if there's not enough income (i.e. no income).

Past 1 year's return is required for I-864, past 3 are optional. You will also need to prove you have not given up US domicile. (US address, US bank accounts, US driver's licenses, US voter registration, are evidence of maintaining US Domicile). If you did give up domiclie you should provide good evidence of re-establishing domicile, such as US Citizen moving back to USA before the interview, and finding a job, and housing.

US Domicile is a requirement of the I-864.

Many who do DCF, will use a Joint sponsor in the USA.

Yep, Thankfully I have my driver's license registered with my parents' address, and my bank account and credit cards are all registered at that address.

2006 if interview falls before April 15, after that and the consulate may want to see 2007 return.

Timeline

While technically only the 2006 return is required for the I-864, I would go ahead and request the transcripts for 2004 and 2005 and have them at the interview.

Part of the affidavit of support they are also looking at is your ability to support the beneficiary after you move to the U.S. - they may well request those two years at the interview.

As your interview is so soon, you can call the IRS and ask them to fax them to you. Each transcript is around 9 pages just so you know.

2007 years tax transcripts will be required for people who file their cases in 2008 or those who have interviews after 14 april 2008 which is mostly the deadline date for filling year 2007's taxes. Just relax.... 2006,05,04 are enough of you and ur co-sponsors.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

When we filed in jan 2007 my husband just submitted a signed statement saying he was not required to file a U.S. tax return in 2005. Our co-sponsor was his 20 year old cousin who had only filed one tax return in her life. So we submitted a copy of that one. Since she hadn't made enough to meet the income requirements we submitted a bank statement showing we had 3x income requirement - her income. Our petition was approved on the spot.

Dec 19, 2006 - Married at the city hall in Denmark

Jan 05, 2007 - Filed I-130 at the US embassy in Copenhagen (Approved)

Jan 30, 2007 - Received e-mail from embassy, I-130 has to be re-approved in London, we both need to file G-325A

Jan 31, 2007 - G-325A sent to US embassy in Copenhagen

Feb 15, 2007 - OP-169, DS 230 I & II, I-864 sent to US embassy in Copenhagen

Feb 27, 2007 - US embassy Copenhagen, I-130 re-approved and back

Mar 03, 2007 - Receive packet 4 - interview date April 12th

Mar 06, 2007 - Call from embassy - interview date is now on March 8th

Mar 08, 2007 - Interview at embassy - Visa approved IF medical report is all clear

Mar 14, 2007 - Medical exam

Apr 07, 2007 - Visa packet received

Apr 17, 2007 - POE Newark Intl. Airport

Apr 23, 2007 - USCIS refuse to change my mailing address

May 07, 2007 - Re-file for SSN

May 10, 2007 - USCIS receive visa packet from Newark

May 11, 2007 - Gets SSN

May 19, 2007 - Receive SS card

Jul 10, 2007 - Receive letter from TSC: greencard returned by post office - will re-send (duh!!!)

Sep 17, 2007 - Receive Welcome Letter

Feb 01, 2008 - Gets NC License - DMV will only issues it until Apr 17 08 (expiration date on entry visa in passport) since greencard not in hand

Mar 06, 2008 - After 10 months and some change GC FINALLY in hand!!

Apr 17 - Present: USCIS has managed to switch my case # with some else, send my greencard to the wrong address and had to make 3 - yes 3 - service requests on sending out my card
