im still at the packet 3 stage before the interview in juarez. we plan on filing for aos as soon as my fiance arrives. so we will pick up her daughter in mexico once her advance parole is approved. my question is when does the biometric take place since her daughter will not be present in the states till after the advance parole is given. is this something that can take place anytime before the aos interview or is it soon after you file for aos?

Hi

You have to get married before filing for AOS and you can apply for your Advance parole at the same time as your AOS. I applied for AOS and EAD at the same time. Finger printing can happen any time. I had my finger printing done before my son, but if the child is not here and you get a notice for finger printing just change the date to a date when you know the child will be here, as she does need to have finger printing done before AOS. But having said that when my son and I went for some reason they had lost his biometric info so we had to go and have it done again, but he could not have it done that same day as our AOS interview cause he had just had his lip pierced and they will not take a pic with the ring in his lip and he could not take it out, so they stamped his letter and we just went back when he was able to take the lip ring out.

thanks brit. so basically i can file for aos ,ead, and ap once we get married since that will be as soon as my fiance enters the country and then we can have the biometrics done once the daughter arrives, probably as soon as 3 months when the ap is approved?

You can have the biometrics done as soon as the USCIS schedules it. This occurs after you apply for AOS for the daughter.

YMMV

ok ..this is a bit confusing.i know that the new fee includes ead,and the ap.so since my fiance will need ap to leave the country so we can pick up her daughter we have to file for that . now..since the daughter will not be here does that mean i have to file for aos seperatly for the daughter and pay a higher fee or just the biometric fee?

You get the fee discount for the K-2's if the K-1 and any K-2's file concurrently... If filed separately (which is your current scenario), the fee will be the same except the biometrics if the applicant is under 14 .

ok fwaguy..one more clarification to ease my thoughts..sorry. so i just looked at the fee chart and its $1010 for aos including ead and ap. $600 for child under 14. since we will file her daughters aos (shes 5 yrs) after our fiance does, will daughters fee be $1010 too?

It will be $930 as you will avoid the $80 biometric fee because of her age

YMMV
