US CITIZEN WITH WIFE AND THREE KIDS IN MEXICO

Timeline

Hello my name is Bryan I have a wife and three kids in Mexico I do not know how similar my story is to others I hope it's rare! trying to keep it short as possible after finally getting married in 2/11/07 in Mexico after a two year battle. I hired who I could afford and who would accept a credit card for payment http://www.ezvisa.us/ god forgive my sole I ever meet him! Me and my wife submitted all information for k3 130/129f when he sent it back to us for us to sign we found 86 mistakes! I was outraged and shocked, I was also embarrassed when I a farmer had to write a letter which took me two days, to a professional white collar dude and notify him of his mistakes he made. I wrote out the questions, then wrote what he had put, followed by what we had originally sent, as we had saved copies of everything before we mailed it to him! Surprisingly he was mad and responded with a sharp tongued letter and denied everything. After I sent him my originals and asked him to compare what his office wanted us to sign versus what we had sent, and pointed out what I believed to be intentional mistakes, such as my three years w2's I had sent, that were about 53, 58 and 61thousand for 04, 05, 06, he had put something like 76, 91 and 217 thousand how could that be a mistake. Then he admitted their were mistakes, but can you believe it, I had to fix them all! When I resubmitted the forms, this time in pdf format he said that I had made changes that were unacceptable to usics but he would go ahead and mail them anyways. I asked for my money back as I had hired him to submit all my papers to the government properly and without error and that I, nor anyone needs someone to submit papers with error's he changed is tune apologized for his, and his business’s behavior!

[three times i asked for my money back, quoting his policy from his website. I never have got my money back but each time i get a immediate change in behavior and apologies the I-129 fiasco is unbelievable]

Next thing we know he calls us franticly saying that theirs going to be a rate increase at usics and he needs to mail the papers rite away and there’s no time to mail our papers again he suggested that I allow him to make all the needed changes and to let him forge our signatures and send them out rite away my wife now 6 - 7 month’s pregnant and fearfull of all the time it would take just to get back to the point of a lawer submitting my papers i agree! God know what he put on those papers!

Finally my I 130 was mailed in April or may and I received my NOA June 20 2007 the I 129 was a nightmare but received my NOA on December 17 2007. I received a RFE for my I 130 12/19/07 my wife was married and divorced I was told by this guy at ez visa that all translations need only be done by someone other than family and they need only submit a letter stating that they are competent to do a translation. This did not prove to be true my RFE was for a certified notarized translation of the Spanish divorce decree I sent this write away certified return receipt insured with confirmation and it took uscis 30 days to say they got it can you believe it.

also I was nervous about the RFE because it was contradictory it said “ all document submitted in Spanish must accompany a certified notarized translation yet they only asked for the divorce? There were other document such as a custody decree in Spanish I called them and asked if I should have other translation redone, they said no only send what we ask for? well in a round about way they asked for both! I sent the following along with RFE

Enclosed is, Notice of action and attached paper, an exact copy of the divorce decree, a certified, notarized translation of the divorce decree along with accomplishments of translator for creditability!

If any other information is needed I will overnight it! I hope you find the enclosed translation to be both Acceptable and Creditable as I spared no expense looking for the best translator I could find, and returned the requested information as quickly as possible! Since filling I have a third child, a brand new baby boy; almost seven months old and I am eagerly awaiting the opportunity to see him and my family every day, for the rest of my life!

I don’t know if it good to send a letter but I did. I now have many question and am growing impatient as my baby boy is now 8 month’s and I have only seen him twice! What’s next, I was kind of excited after reading a little that after you receive a RFE often people say you can look forward to be reunited with your family in around thirty days. But what’s this talk of interviews, finger prints, biometrics, adam walsh how long dose this ####### take? What interviews? Where are they? Here, Mexico, both? I want to go see my wife but I don’t have much money, and I was afraid I would be approved and I would need the money to bring her here. But if she’s going to be interviewed that’s another trip to Mexico I’m not letting her go to some border town alone. So can someone explain to me where I am at rite now what should be happing next, what is referring to when people have on there time line “touched”, also on my time line it says;

“Based on timeline data, your I130 may be adjudicated as early as October 13, 2007*. “

If this date has passed by more than 10 days or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.

Well were way past that so what dose that mean?

I have read of people entering the united states before I 130 approved?

when or if I get approved what’s next?

what if I am denied?

how do I get my wife here from Mexico I fly over we pack her bags grab the next flight to Chicago or do you have to go to the border or immigration other than the one at the airport?

I herd you can only leave by car is this true?

There is a lot of fly-by-nights out there, do i know thaaaaat. You sound very frantic and I can understsand your frustration, I've been there, should you need to have something translated send it my way I will help you, I don't know of any other way I can assist you
