New UK Police Certificate process for US visas - you MUST read this!

So then - soes this mean that for non-immigrant visas you can still use subject access, but not for immigrant visas?!?!?!?

I don't believe so. I trolled around the website and followed the linkies within K1. I think this pertains to all visa types.

Plus I can't think of a good reason why they wouldn't want the procedure to be uniform.

Also - K1's are processed within the immigrant visa unit. But to make doubly sure, I still followed the links.

My IR-1 Timeline:

2008-01-30: Mailed I-130 petition to USCIS London (DCF)

2008-02-04: Credit card debited $355

2008-02-07: NOA1 received - file date 4 Feb 2008

2008-04-19: NOA2 received - APPROVED (took 74 days)

2008-04-23: Packet 3 received

2008-04-28: Packet 3 (DS-230 Pt 1 and statement of readiness) mailed in

2008-04-28: Medical appointment booked

2008-05-13: Packet 4 received - interview in mid-June

2008-06-16: Medical - no apparent issues

2008-06-17: Visa interview - APPROVED - total 135 days from I-130 filing date

2008-06-23: Text message from SMS couriers - passport and MBE being delivered 2008-06-24

2008-06-24: Passport arrived along with MBE

Extended pause while we sold our house! (nightmare)

2008-11-18: Arrive in the USA - POE = EWR (Newark/Liberty Airport)

2008-11-25: Take 'written' (computer) knowledge test and 'skills' (driving) test - PASSED - license issued with expiry of just under one year*

2008-12-03: Purchase and insure car

2008-12-10: Receive title to car

2008-12-15: Go to BMV and get plates for car

2008-12-16: Receive Welcome to America letter (I-797C)

2008-12-20: Receive second Welcome to America letter (I-797C)

If you have applied for, or are in possession of a Subject Access Statement, and you will appear for a visa interview before August 15, 2008, the Nonimmigrant Visa Section will accept this Statement, provided it was issued within 6 months of the date of the visa interview. Applicants appearing for interviews on or after August 15 will be required to furnish the new style police certificate from the ACPO."

Excellent information. Thanks for finding this, will prevent a lot of people with pending interviews panicking and prompt those applying to obtain the correct certificate. Thanks again.

3. I authorise ACRO to make any enquiries it deems necessary in relation to the information given on this form and to share this information to the extent necessary to enable a decision on my Immigration Application.

That is very worrying. ACPO is just a staff organization, like the Police Federation, but for high ranking police officers. As such the officer in charge of Met Police Counter Terrorist Command, which incorporates what was Met Special Branch is an ACPO member with complete access to all Special Branch records. There is no way of knowing who will see your information, what checks they are doing or what information will be passed back that you know nothing about.

I feel I should reiterate this is for NON-immigrant visas. Those applying for immigrant visas may need the new ACPO report regardless of whether they already have a subject access statement or not.

If you follow the link from http://london.usembassy.gov/cons_new/visa/iv/ds2001.html it still states the subject access form for immigrant visas, however I think this info page has just not been updated since this link http://www.usembassy.org.uk/cons_new/visa/iv/ukpc.html clearly states ACPO as the source.

It really does look like ACPO is the form to apply for unless you have already ordered a subject access form and you have an interview scheduled before the 15th August 2008.

Ok. I see the confusion.

Maybe you should email and tell them they missed a spot............ :jest:

I was livid when I emailed ACPO! It's not my usual style I have to say but it was one straw too many (or seemed that way last night :P )

Still awaiting a reply. Glad someone found there really is a cooling off period on the old form.

Both links now say an ACPO report is required and mention NOTHING about a cooling-off period for the old subject access form.

If anyone has attended an interview in London in the past month and successfully used the subject access form, can you post here please?

Someone on the BritishExpats forum just had their interview friday (for an immigrant visa application). He asked the consular officer when the subject access certificates will be accepted until, and the answer given was APRIL 15TH. So it looks like the 15th August date is nonesense - or maybe it just applies to non-immigrant visas.

So if you have your interview for an immigrant visa in London after April 15th, better get an ACPO certificate sorted.

He asked the consular officer when the subject access certificates will be accepted until, and the answer given was APRIL 15TH. So it looks like the 15th August date is nonesense - or maybe it just applies to non-immigrant visas.

So if you have your interview for an immigrant visa in London after April 15th, better get an ACPO certificate sorted.

So, if Darren interviews for a K-1 visa, the old police certificate should be okay, yes?

yep, my old certificate was accepted. As long as his interview is before the 15th April according to this. Though, it was previously reported that the cut off date was 15th August (which would be six months from the ACPO coming into effect. So I hope the CO gave good info on this new April date. It's a shame the embassy site no longer shows any date. I'm inclined to think the CO was mistaken - but it's too much of a gamble :(

Unbelievable...you try to prepare, and they change the rules...and you can't take a chance that you'll get the interview before then...so they have you between a rock and a hard place...
