Hello,

We were instructed incorrectly and filed I-130 only earlier. Now, we have to file I-485 but I received different answers from the immigration officers on the phone. One told us that the policy has been changed and we don't need to wait for the approval of the I-130 anymore but just use the I-130's Notice of Receipt to file I-485 together.

Is this correct? I'm not confident with their instructions and would like to double check on this. Can someone help? Many thanks!

Yes, just enclose a copy of your NOA1 for the I-130 with your application for AOS...

Thank you, Kez. Although another USCIS officer gave me a different answer (i. e., wait for the approval of I-130), I think this should be true because it makes sense -- I know they process all forms in one package simultaneously, not one at a time.

However, I've been searching around but couldn't find anything to support this. Do you know where I can find such information on USCIS website? We just don't want to repeat the mistake like last time without double checking when they told us to just file I-130 alone. (Maybe they misunderstood our situation???)

We I filed I-130 and AOS together and no you dont need to wait for the I-130 to be approved first.....
