Timeline

OK so to be on the safe side I have asked my soon to be Dad in law to Co Sponsor my son and me.....My man has made just under 21 000$ in taxable Income last year.

He currently has a VERY good job but the problems seems to be that whatever he makes in Per Diem Pay is not counted.........

Once he starts his second year working for that company he will have a TAXABLE Income of over 50 000 $ which that will be in October.

So can his Dad then withdraw his I 134 /I 864 ???

Somehwhere I believe to have read that as soon as the Petitioner meets the 125% the Co Sponsor can get out of the game,is that right?

Also what documents do we need from his Dad? Last 3 years of W2's,Letter from Employer and I 134 correct???

Does anybody here have any experience with Per Diem Pay and them not accepting that as ncome suitable for the I 134?? Maybe even someone going through Frankfurt Germany?

I was digging through the archives here yesterday and someone had a similar problem,their Co Sponsor was a Trucker and since he made 23 000$ in Taxable Income and 27 000$ in Per Diem they actually had to find a whole new Co Sponsor..........

Please someone help me out here!

There's no need for anybody to get out of the I-134. It isn't binding anyway and is replaced with the I-864 when you file for status adjustment to permanent resident. The primary sponsor can simply claim their current income annualized and provide evidence of that current income level. They don't have to prove they already made that much for a whole year. If you can do that, you don't need a co-sponsor for AOS. If you use one, they stay on the hook for the same time as the primary sponsor.

If the income shows as gross income on a W2, it counts. If not, then use the number from line 22 on the 1040.

Facts are cheap...knowing how to use them is precious...
