I am a USC. What is the difference between a K3 and CR1 and which is quicker/easier?

K1 Visa Timeline :

07-27-2007- Sent out I-129f

08-07-2007 : Received NOA1

12-23-2007 : NOA2 approved

12-27-2007 : NVC Received

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

AOS

06-06-2008 Mailed out AOS

06-08-2008 Delivered to Lockbox

06-16-2008 NOA for EAD, AP, AOS(dated June 12)

06-28-2008 Biometrics done!

CR-1 is an IMMIGRANT visa it directly results in a green-card issued upon entry to the USA, it is the superior visa. Green-card allows work immediatly after entry.

K-3 was developed at a time when CR-1 visas were taking drastically longer than K-1 for fiancee, it allowed the married couple to enter the USA and either wait out the CR-1 visa and travel back to home country to interview, or adjust status in the USA.

K-3 is still slightly quicker than CR-1, but if you compare timelines, you will see that K-3 for most countries is only slightly quicker.

K-3 has the added pain of dealing with USCIS to adjust status, ($1010) and is not work authorized, has to apply for a work permit, takes 90 days or more to get, all that time unable to work, get SSN, and unable to apply for a driver's license. AOS can take months to years to approve.

So what your saying is...

the CR1 visa is simply filing the I-130 form WITHOUT sending in the form I-129F after receiving the Notice of Action?

I am a bit confused on this also.

I thought the K3 WAS the I-130.

Is it not? Please help me with my DISCOMBOBULATION. hahaha

05/27/2008 - Filed Expedite Request by phone with CSR

06/01/2008 - Received Denial Email

06/05/2008 - Filed 2nd request

06/23/2008 - Expedite Approved

07/27/2008 - NOA2

10/21/2008 - Case complete at NVC (Technically was expedited to embassy)

11/06/2008 - Interview at Dakar Embassy

11/06/2008 - Notice (show more income evidence from petitioner)

11/07/2008 - Case on hold

11/18/2008 - 2nd Interview Date

11/18/2008 - Notice (Show even more income and ORIGINAL docs now from 1st cosponsor

12/23/2008 - Received email for 3rd Interview scheduled for March 25th, 2009. Bring Pics

01/23/2009- In Gambia with hubby

03/25/2009- Interview

04/09/2009- POE Atlanta (CR-1 Status until 2011)

04/13/2009- husband arrested for domestic violence (Aggravated Assault-Felony)

05/19/2009- Filed for divorce

06/02/2009- Letter sent to immigration detailing abuse & fraud

09/08/2009- Divorce Hearing

09/10/2009- Divorce Trial (Continued)

03/11/2010- Notice To Appear issued

03/22/2010- Divorced

05/18/2010- Deportation Master Hearing

05/18/2010- Deportation Ordered

06/17/2010- Appeal Time Over. ICE picked him up. In Jail

08/10/2010- Another Master Hearing Scheduled. Out of jail.

05/31/2012- Individual Hearing Scheduled

its all a bit confusing, the 130 is for cr-1, when you file the 129f after receiving the NOA, you are then filing k-3. But now there is some confusion and rumor that the K-3 is no konger available ??? this really clears things up for you, huh? lol

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

I-129F is the filing for K-Visas, K-1, or K-3. I-130 is for IMMIGRANT visas, CR-1, IR-1. Filing the I-129F after receiving I-130 NOA1 letter is what starts the K-3 visa process. NOT filing I-129F will result in CR-1 visa.

Correct but perhaps equally important is that the anecdotal evidence we have, consistently indicates that since July 29, 2007, filing an I-129F for spouse is a bad idea. It slows that process and doesn't result in a K3 visa interview. This may change but it hasn't yet as far as I know.
