Hi,

I am new to visajourney.com. I have read most of the guides but I still have some questions. I came to the US on a tourist visa years ago and I recently married a US citizen. My question is: Does my new wife have to file a I- 485 and a I-130 for my daughter, or is just the I-130 neccessary? My daughter, who was born out of wedlock, does live in the US but no longer lives with me since I seperated from her mother. Both my daughter and I have the I-94.

Any additional advice/information about this case will be greatly appreciated!

Can you provide a few more details? Did you overstay this tourist VISA and are here illegally since? Was your daughter born here? Why would your new spouse need to apply for your child who doesn't live with you? There are folks on here more knowledgable then me who can perhaps shed light on how that would work or not.

Both my daughter and I are here illegally. We overstayed on our tourist visa. Yes, I can apply for her, even though she does not live with me because I countinue to support her. I am unsure if my wife needs to file both the I-485 and the I-130 for her or just the I-130.

I'm still looking for someone who has knowledge or are going trough this similar AOS, I'm ready to send my AOS but I would like to include my daughter.

I wish I had an answer but the part about the child already being in the US out of status is beyond my knowledge.

Hope someone can answer though. I know for my step kids who were out of the country we filed the I-130 adn went to NVC then to the embassy in Bogota.

Why is it that the only one who can stop the crying is the one who started it in the first place?

4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well

It is like a SAT question trying to trick you. I already start filling it. I will soon start my timeline, sure this will interest a lot of people.

Nothing wrong with the arithmetic except you'll be sending two I-864 forms. I think it's better to look at each package separately. I would write a cover letter for each and an overall cover letter. There will also be two separate checks.
