hi thanks for your replies.

The RFE say in these exact words:

Form I-864 Affadavit of support was submitted, however it was not from the petitioner/sponsor.

Then it just requests we send one in for the sponsor listed on I-129F.

We submitted a form from my sponsor (wife) with the box first of two sponsors ticked. We put on her form her married name. With this we attatched an I-864A from her father who is the co-sponsor and all income requirements and all asked for tax information.

Any more advice based on this post?

Thanks to everyone! At the moment what we will do is just re-send the I-864 for my wife with the box ticked saying she is the petitioner.

Yes, if you'd mentioned that in the beginning, it would have been clear. She didn't check box "a" on the original submission and she should have. Even though her father is supplying an I-864A (as a household member) she is the petitioner and not a "joint-sponsor".

Submit a new I-864, with box "a" checked, and have her include her father's income in the household. She signs the form, he signs his I-864A.

Thanks for your reply. so would just ticking a box wrong mean we get an RFE? How come it says we didn't have one from my sponsor/petitioner? We will try that then and send it in, it's ridiculous though as we rang and spoke to three different people who all said to tick the box we did, they really do know nothing on there helplines!!!

Nothing directed at you specifically, but why would you be exasperated at the incompetence of some contract workers? I know it might seem unfair, but it's your immigration journey and they have nothing at stake when they make an error, but YOU do. I would recommend that you read, and read again all of the instructions when submitting anything to USCIS. If you have any questions or are at all uncertain of anything, before sending it out, ask away! Members here and elsewhere are happy to chime in.
