my ex got pulled over on a speeding ticket. (he was illegal in this country) didnt have a valid license from our state and got a ticket, when he went to pay the ticket they pulled him into court....detained...2 weeks later deported.

i would NOT by any realm of the imagination think it was safe to drive for you right now, especially since your considered illegal as well.

i dont know for sure about traveling (and i assume you mean by plane) but i know as far as driving its really not a good idea to drive. i mean GREAT you havent been pulled over YET, but in the slight chance you might, i wouldnt want to take that chance...

You've already passed your status so you are here illegally, but every day you are here is a risk that you will be caught. If you are caught after violating a K1 you will probably have a very hard time re-entering on the same visa or any visa. If he isn't willing to move to your country to be with you then you are risking your entire relationship and any chance you have of being together.

How will violation a K1 visa influence visas to other countries?

Tashyta, you're not the only illegal person in the U.S. This is not 1945 Germany, so you don't have to be paranoid. However, something seems very weird since your visa expired 9 months ago and you're still together with your 'fiance'. Anyway, you ask if you can drive with your license from Ukraine, the answer is no.

And you also ask if you can travel inside the U.S., the answer is yes, as long as your passport is still valid. Not that they ask for passport to travel inside the country, but because I assume it's the only form of valid identification you have.

Lastly, I'm no expert but I don't think this violation will influence visas for other countries.

If you do travel within the U.S. by plane you will need to present some form of valid picture ID. I'm guessing all you have is your passport. And I'm not sure you want to show up at the airport with a passport with an expired visa.

As a side note if your fiance says it doesn't matter about getting married or simply isn't willing to marry you at this point I suggest you return back to your country. Because like you said you have no rights or anything here.

I know a girl from sweden who overstayed last time she was here which is esentially the same as being here illegally. During the fingerprinting at the airport when she was going home an immigration officer pulled her into his office and as a result she is no longer allowed back into the U.S.

May 11, 2007 - Gets SSN

May 19, 2007 - Receive SS card

Jul 10, 2007 - Receive letter from TSC: greencard returned by post office - will re-send (duh!!!)

Sep 17, 2007 - Receive Welcome Letter

Feb 01, 2008 - Gets NC License - DMV will only issues it until Apr 17 08 (expiration date on entry visa in passport) since greencard not in hand

Mar 06, 2008 - After 10 months and some change GC FINALLY in hand!!

Apr 17 - Present: USCIS has managed to switch my case # with some else, send my greencard to the wrong address and had to make 3 - yes 3 - service requests on sending out my card

1.) It is usually a state by state decision, but normally your Ukraine driver license is considered an international driver license already and could be used for about 6 mths before having to get a state issued one, but you would need to be insured and have auto insurance coverage or you will get a ticket and fine for that for certain, which will then lead you to the path to bigger problems your overstay of the 90 day visa, it is not wise what you are doing. I do not understand your statements, your boyfriend/spouse to be has decided on his own not to marry you during the 90 day period and thinks it is ok for you to just hang out and live inside USA all this time? He is grossly wrong if so, sounds rather like a very unusual situation.

2) NO you are not even supposed to be inside the USA any longer, plain and simple you have broken the immigration laws and you will have serious problems, because there is no doubt going to be your arrest if you are pulled over then they check your ID or passport then visa, you will be detained and deported and more than likely never allowed to enter the USA again for a very long long time if at all. Sounds like your spouse to be is either very foolish or lying to you and misleading you into believing it is ok to stay in the USA without getting married and that is incorrect, you have to get married within that 90 day period, it is a K1 and that is what it is for marriage, nothing else.

As everyone says, you are out of status as far as immigration goes, I don't need to repeat what everyone else wrote about that.

About your driving, though. How long are you allowed in your state to drive LEGALLY on your foreign license? I know here in TX it's a maximum of a year. I was also wondering about insurance. I know our insurance company wanted Mark with a US license asap. They would only insure him for a max of a year on his foreign license because he was a resident here and not a visitor. Is the auto insurance covering you driving around when you are neither legally here as a resident or visitor? If your insurance is anything like mine ( USAA), you may not be covered at all. Which would make you not only out of status here as far as immigration goes, but driving illegally too!

I have read your other threads...My heart goes out to you......I am so sorry your fiance does not see the seriousness of the position you are in. You guys really NEED to marry and adjust status...asap. The consequences WILL be a ten year ban if he leaves it much longer!
