We filed an I-90 because the status category on my wife's card is wrong. It should be IF1 but the card says IR6. The problem is that my wife's wallet was stolen just before we mailed the application, so we weren't able to return the card with the application. We weren't sure whether to go ahead and file the I-90 with option 'd' or file it as a lost/stolen card and pay the fee. We ended up trying to file based on the incorrect card. We sent the I-797D (mailer that came with the card) with the application and a letter asking that the requirement to return the original card be waived. We figured it's still worth a shot since we're not out any money except for the postage.

My wife's wallet was returned to her yesterday with her green card. Now we're not sure what to do about the I-90 filing.

What are the odds they'll accept the I-90 without the card? The 800 line told me they don't issue receipt numbers for I-90 option 'd's, so we're not sure it's wise to just send the card separately since we won't have a receipt number for them to link the card back to the I-90 with.

Any thoughts on what we should do?

USCIS instructions for replacement of an I-90 state:

If your card was issued with incorrect data due to USCIS administrative error, you must mail a new I-90 application using Application Reason "d" My card was issued with incorrect information because of a USCIS administrative error, and any supporting documentation, to the USCIS Service Center/National Benefits Center(NBC) that processed the application/form from which the incorrect card was created. Check the envelope that your I-551 permanent resident card came in to find the mailing address of the Service Center/NBC that mailed you the card. The Service Center/NBC address can also be found on the I-797 "Notice of Action" issued for the application from which the incorrect card was created. In addition to the new I-90 application, applicants are required to send the original I-551 card containing incorrect information, plus the supporting documentation for the requested correction. A replacement application based on a USCIS administrative error must also include an explanation.

I'd send correspondence to both locations, including the NOA number from the original, incorrect card and A# as reference and a copy of the correspondence you sent initially explaining that the card was incorrect from inception, but you had not included it.

If it works you're ahead, without spending the money. If you don't get any sort of response within a reasonable time, you could always re-submit a new I-90, and let sleeping dogs lie.

Why do you think it is wrong IR6 is what is on most greencards got through marriage....

He's getting worried that since she adjusted here froma K-1 that it should be more accurate. Frankly, I am not sure all the local offices follow chose classifications as closely as all that. :)

Are you suggesting we return the card to the service center or just send them a letter with a cc to the NBC that we have the card back in our posession if they want us to send it?

We didn't have any problems traveling out of the country on my wife's conditional card which was a CR6. I've also heard of other K1s being adjusted to IR6.

I don't want this to be an issue when my wife applies for citizenship. It's their screw-up, but I'm worried they could punish her for it if someone notices the error. The other issue is that we've paid over $1000 for the adjustment of status and removal of conditions. For that amount of money, the least USCIS can do is to do their job correctly.

Why have the separate IF1 category for K1 adjustees if they aren't going to be consistent on using it? The only reason I can think of is that an IF1 is based on an approved I-129F, but an IR6 is based on an approved I-130.
