Emergency interim EAD

Timeline

Has anyone every gotten or applied for an emergency interim EAD well before the 90 day window? My employer is freaking out because I wont be able to work till I get my EAD..which could be another couple of months. I'm in the healthcare field, and my position is a critical one. The HR department is willing to write a letter stating they desperately need me at work, and that without me, patient care will be impacted. Do you think that will work? Any suggestions?

I have an appointment next thursday with INFOPASS, and I'll be able to bring in the letter from my employer. I figured I'd write one myself as well..who knows what will help!

I got this from the USCIS website:

Interim Employment Authorization CardsLocal Offices no longer accept nor adjudicate Form I-765 “Application for Employment Authorization.” The Service Centers or the National Benefits Center are responsible for adjudicating any, pending Form I-765 and issuing interim or non-interim documentation.

If USCIS does not approve or deny your Form I-765, Employment Authorization Document (EAD) application within 90 days, or within 30 days for an asylum applicant, you may request an Interim EAD (Note: Asylum applicants are only eligible to file for EADs after waiting 150 days from the date of properly filing their original completed asylum applications).

To request an Interim EAD, you must schedule an INFOPASS appointment, on our website, to visit this office in person. You must bring the following items to the office: proof of your identity and any documents that USCIS has sent to you regarding your Employment Authorization application.

Once you make your request at the Local office, the local office personnel will forward your request (send a referral) to the Service Center for processing and inform you of the next steps.

Did you apply for AOS (your timeline only states I130) and EAD already? There is no such thing as an "emergency EAD", but an interim one can be requested of MSC (not issued by your local office) but we havent seen anyone get one since those regs changed in 2006.

Can you fill in your timeline a bit ? May help to understand the situation. I noticed you had another post in Jan about how you're here on an H1B which expires Feb 18?

I'm no expert, but it seems you may have caused a problem for yourself just by accident. not being judgmental here.... but maybe it would have been better to renew the H1B and then get married...then lots of time to apply for the AOS if you haven't already.

Good luck at the infopass appointment and let us know the end result.

i actually did try to update my timeline, but for some reason i'm having problems. I did apply for an AOS, EAD etc on the same date...

as for renewing the H1B, I did consider that and started on the process. There were some issues with some documents i needed to get...some very old school records that no one seems to know where they might be. I had tried for about three months just to find out if anyone had them (including emails to the MP and MPP, and every ministry i could think of), to no avail. Then several weeks of trying to get though to the agency that dealt with the Visa Screen here. They suggested i make an appointment and go to their office..in PA...i'm in CO with absolutely no guarantee they could even help me...especially frustrating since what they kept suggesting i do, i had done already,and had documents indicating that what they asked for wasnt available. sooooo...by this time it was getting close to the wedding, so I just figured I'd go the other route, rather then pay twice for the same thing.

I'm sure all of you know just how frustrating all of this is. It seems no matter what you try, something is in place to make things more complicated!

I'll try to adjust my timeline again...maybe i'm just dense becuase i'm sleepy (i work nights and havent been to bed yet!)

BTW..how do you know something was 'touched'? Also, how long does it take for things to appear in the computer? My AOS showed up really quickly, however nothing else can be accessed.

I just keep mental track of when the last updated date is changed.....that's what is meant by touches...work has probably been done, but not an actual change in status of your application

You could always just Edit your signature (under My controlls) and fill in a few details - makes it very viewable immediately to any VJ reader when you post something
