Timeline

Just got back from spending a month with my wife in Russia when I got a nice valentine's gift...I-130 approval (K-3 filing). Still have a I-129F pending that I filed shortly after filing the I-130 (one week later). I see that the petition is going to the NVC next. I imagine the I-129F is still active but maybe not. Any suggestions as to what happens next? How long until interview? Will they kill the I-129F petition or go forward? What is the likely scenario now?

Any information is appreciated. Thanks!

congrats on ur approval, well atleast u have one option available to you vs. me where my application is lost in the blackhole, i guess i have no more hope left of an adjudication rather than be a complaining ahole on this forum, its time to quit the race.

Congratulations! Your I-130 should be approved for CR-1/IR-1, not for K-3. I am not sure what will happen to your I-129F petition for K-3, as there were some recent changes. But at least, your I-130 is approved!

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Congratulations! Your I-130 should be approved for CR-1/IR-1, not for K-3. I am not sure what will happen to your I-129F petition for K-3, as there were some recent changes. But at least, your I-130 is approved!

Hell I just woke up from taking drugs and with this news Im going back to take more see ya all in a few months - serious side tho - you really are there with that I130 and logic would show that the I-129f would be binned - oh wait its USCIS right??? Congratulations . I gues you broke the record of fast approval. Applicants from July -August are waiting approval. Forget I-129F as I-130 is already approved. they will cancel it automatically.

It's not always better to have the 129F cancelled automatically upon approval of 130.

In my situation we might choose to delay entry into US due to employment purpose. With 130 approval, Visa expires in 4 months. But a K3 expires in 24 months.

I'm actually praying that a few things tip in my favor ( tho not probable ).

1: USCIS approves my I-130 before 129F and send 130 packet to consultate for processing. This will save time ( who knows? ) and money ( $350 ) in having to file I-824 for case redirect. Durign this time they could process our greencard, etc.. at the consulate. Shortly after, they approve the 129F for a K3. It'd be a win/win but wishful.

2: USCIS approves my I-129F first and mistakenly sends my I-130 to consulate for processing. The current policy states USCIS will hold 130 upon 129 approval YET some people are still getting both sent. I'm hoping for the same. We'll get a 24 month visa while my wife and I await our 130 processing together.

We want the K3 approved asap but we want the flexibility to enter US when employment contract ends. Does anyone know if it's possible to request extension of the CR1 VISA? If it's possible, I'm leaning towards cancelling the K3 altogether....condition on earlier approval of 130.

You still seem to be confused. An I-130 approval is not a visa. The approval of the petition expires in four months but Consular officers routinely extend the validity of the petition approval as long as they need to make a decision on the visa.

Once an immigrant visa is issued, it expires six months later. Your need for a delay of a few months can be accomplished with either visa because you can control the speed the I-130 goes through NVC. For instance, if your I-130 was approved today, you could delay visa issue until December or January and US entry until May or June, 2009. If you need longer, the K3 allows for that. Since your I-130 was held, you'd be looking at around June 09 for visa issue anyway because of the I-824 processing time.

Individual circumstances determine the best path.

I can appreciate your passion in helping. But I think you're jumping the guns a little based from your personal experience. Not too long ago you were recommending that people not submit both 129 and 130 together. Well, I did just the opposite and was accepted fine.

You still seem to be confused. An I-130 approval is not a visa. The approval of the petition expires in four months but Consular officers routinely extend the validity of the petition approval as long as they need to make a decision on the visa.

Of course, the 130 is not the VISA. How else would you explain the time difference from 130 approval and consular processing for the VISA? I would imagine that others here also understand that the petition can be extended until complete processing of the 130 petition; namely to allow sufficient time for document preparation, medical exams, investigation, etc..etc..

Once an immigrant visa is issued, it expires six months later. Your need for a delay of a few months can be accomplished with either visa because you can control the speed the I-130 goes through NVC.

I think you're missing the point here which is.....THE DELAY IS NOT THE ISSUE. The issue is getting delaying the visa issuance while simultaneously having the I-130 processed.

For instance, if your I-130 was approved today, you could delay visa issue until December or January and US entry until May or June, 2009. If you need longer, the K3 allows for that.

We would prefer a visa in hand asap ( through the effect of 129f petition ) so we can travel back and forth in the interim while having the 130 processed at the foreign consular, thus avoiding the additional fees associated with AOS, immigrant VISA surcharge, and I-864 FEE, etc...

Since your I-130 was held, you'd be looking at around June 09 for visa issue anyway because of the I-824 processing time. Individual circumstances determine the best path.

This is once again speculation. We don't know how long it takes..maybe a month maybe a week too.

It's key to notice that one person's experience does not mandate future process but rather a sensible guideline for future process.

The simultaneous processing of both petitions at the foreign consular or the traveling back and forth?

It's wishful thinking based on individual cicumstances. With the right sets of circumstance in place, it can happen.

What we do know is that some people have had the privilege of getting both approved petitions sent to NVC. So we know that much is possible.
