Everyone,

Just thought I'd start a new thread for everyone that gets issued a GC, with the name check still pending, as per the ruling from a few days ago. If anyone gets their GC as per this ruling, could they please add to the thread, so we can get an idea on how long it's taking to process.

I came to the U.S. in 04 on a K-3 (spouse) visa. My wife I got married in 2002 in Egypt. After I was here 5 months, I filed my I-485 for adjustment of status (March 05). I had my interview in Feb. 06. The officer said they had to do a background check and if I'm lucky it would take 2 months or so. My fingerprints were expiring August 06 and he said it would be finished by then. When my wife asked him would we have to come back again he said no, just wait for your card. Since then, we have waited...and waited....and waited...and we are still waiting. Each time we check online it says pending and even our congressman has called them to check on it and they said the FBI was doing a name check. Then, the other day we saw your post about the change in rules regarding green cards. We called INS the next day and were told the same as you, we should hear by March 10. Our congressman called them the next day to make sure his case was included in the new rules and was told it was. She was told some cases might need fingerprints done or another interview before they could issue a card. No date was mentioned to her at all. When I told her they had given us the date of March 10 she seemed surprised and said she doubted they could do it by then. Evidently, the INS staffer had told her they weren't sure exactly how to implement this new policy and were working out their questions now. So she said she would be surprised if they can get everyone a letter by March 10. Have you heard anything lilke this? I've also been told by a friend that his lawyer told him the green cards issued this way would be 2-YEAR conditional cards, not 10 yr permanent ones ( even if you would otherwise qualify for the 10 year card). If you can shed any light on any of these things, I'd appreciate hearing from you. :help:

The likelihood that new ruling is in effect this soon after the memo is pretty slim, would make sense if for those who already might have waited the 6 months to get an interview though in the future. We still see such a backlog, there is no way for this to be an instinaneous change.

The likelihood that new ruling is in effect this soon after the memo is pretty slim, would make sense if for those who already might have waited the 6 months to get an interview though in the future. We still see such a backlog, there is no way for this to be an instinaneous change.

I spoke to a USCIS 800# representative last week and was told that the '180 days' is in effect now. Since we've been waiting 11 months for AOS (7 months since being transferred to CSC). We were assigned a request # which means an officer from our local office has been assigned our case (they have 15-20 days to assign the case-ours was assigned after the second day) and then they have another 15-20 days to investigate why our case is still not approved and we will then be sent a letter with their decision at that point (decision of what, I'm not sure).

Our senator's office and local office both say biometrics and namechecks are completed and don't know why we are still waiting. Interestingly, our local office didn't know anything about the '180 days' and said they keep getting people coming in asking about it but they couldn't comment on it since they do not have any information about it.

Did you notice that all local offices also claim 180 days and have for the better part of the year since the reporting changes occurred? Depending on what specific question you asked, they ALL state processing time is in 6 months. They moit however, those things that are "out of their control" (ie namecheck). Hopefully you are right, and what you were told from the 800 number is true (it would be a rareity).

Can you imagine - after the backlogs that have occurred since July 2007, now to add this to the pile? This will take quite a bit of time to clean up! :star:

I did ask about the new guidelines of issuing a GC conditional on namechecks pending and they said that it is in effect now. But as you said, it would be a rareity if that is actually true coming from that 800#. And no - I cannot imagine the backlog this will create with the backlogs they are already dealing with. :(

Would be nice, wouldn't it. Perhaps it is, as after 2.5 years we got a fingerprinting notice yesterday. Just because we are speculating bunch here my mind wandered into the realm of - imagine in the attempt to adjudicate all those backlogged more than 6 months, all the current ones waiting will absolutely wait 6 months (ie: shelved until absolutely must be processed). No more 2 month adjudication.

Just me rambling :D

Okay a few questions, so I had my fingerprints done for my I-485 back in December '06 and interview in January '07 and now over a year later I'm still waiting on that stupid name check to come through. However, I was never told that my fingerprints expire? Will I have to have them done again? Also, are you sure about not getting the 10 year GC? I've married for over 2 years and think it's really unfair if I was to get a 2 year GC. Ever since the ruling passed I have not had any updates on my file.

Fingerprints expire at 15 months, and if you are married more than 2 years at the time of adjudication you should receive the 10 year greencard. A few in the big namecheck thread received a 2 year conditional one despite being married more than 2 years. They sent in the I-90, cited it as a clerical error, and had it corrected. We will be doing the same thing if it happens to us. That is the ONLY upside to them failing to adjudicate in quick turnaround. :dance:

i agree, i should get a 10 year GC, however, if you scroll up someone mentioned that a lawyer told them that those pending a name check, even if married for more than 2 years, will be issued a 2 year GC? trying to see if that is incorrect? it better be!

it goes against their own mandate and everything we have seen in the big namecheck thread.

i agree but do you think there's a chance that they start issuing 2 year conditional GC's instead of the 10 year one? any validity to what the lawyer told that fellow?

Anything is possible, and we can speculate with the best of them. As it stands now though you should get the 10 year greencard.
