No. Once you use the EAD, you are no longer in H1 status. You cannot then "extend" your status using your H1 if your AOS is denied if you have already used the EAD, since the H1 is no longer valid

if my H1 expires march 26, 2008 whats the latest day I can file? i guess i could care less if it takes months for the result to come out since i allready have an EAD.

assuming i can use the H1 to "extend" my status assuming the I485 gets denied, and maybe file an appeal.

how do I "use" my EAD? do i need to register it or something? when I got it, I just simply stored it and did some part time job with it.

now that you mentioned it, it really bothers me that my friggin lieyer "strongly advised" to renew my H1.

I think you "use" it by providing the EAD as proof of your eligibility to work. Also, USCIS is probably considering it as being used since it was mailed to you.

The most common ways of "using" an EAD are situations like:

-Getting employment and using your EAD as proof of employment when your employer fills out the I-9 (verification form)

-Using the EAD to prove status to the DMV and get a license

-Using the EAD for Social Security number

-Using the EAD at banks to show legal status etc.

Simply mailing the EAD is not enough by the way. Plenty of people continue to stay on valid H1 status even though they have an EAD. They get the EAD as a backup in case they lose their job etc.

Since the EAD and AP are now included in the AOS fee, it is a tougher call. Before that happened in July, the answer would have been obvious "renew your H1". It is flexible, is good longer, and allows you to both work and travel. But with the inclusion in the fee, it is really your call. If you expect it to be quick, then the EAD and AP included make sense. If it is going to take long, you may pay a lot more in EAD and AP renewals, which is why your lawyer might have suggested getting the H1
