I was denied a B2 Tourist Visa for not having enough ties to the U.K. Will this effect me entering the U.S. under the Visa Waiver Program for the regular 3 months?

Why did you apply for a B2 in the first place (instead of just using the VWP)? Had they told you previously at POE that you were overusing the VWP?

Oh. Well, at any rate it *shouldn't* effect your ability to use the VWP. But keep in mind that the officer at the US POE may want to see proof of your ties to the UK - if you didn't have enough to satisfy them for the B2 visa, you may not have enough to satisfy a POE officer. So you may be turned back.

It might be a good idea for you to route your trip through Dublin - it is actually a US immigration POE, so if you do get turned back, you won't have as far to travel back home.

Be sure to declare your visa denial on the I-94(W) - whatever you do don't lie.

yes..definatly declare it.

if you tell the truth the worst that can happen is you'll be refused entry. if you lie the worst that can happen will be you get pulled up for misrepresentation and that could possibly lead to need for waivers etc!

Correct, Dublin is a pre-clearance station for the US... You are processed for immigration prior to departure in Dublin....

Yes you can clear US immigration in Dublin. Tho be aware this does not apply to all flights. AA does not use it, neither does flights in the afternoon.

I know AerLingus is one of them - I believe BA does too. Would have to Google the others.

When you arrive in the US, the only thing you must do is clear customs.

It actually depends on the flight. Most AerLingus flights do clear immigration in Dublin, but not all do. US Aiways & Delta also use it. AA used to, but they don't anymore. BA does not fly to the states from Dublin.

Its really best checking with the airline, if you really want to clear immigration in Dublin.

There might be a problem here. My understanding was that you can only use if the Visa Waiver Program if you've never been denied a US visa.

From the travelstategov website:

Which travelers may use the Visa Waiver Program to enter the United States?

Nationals of the 27 countries participating in the Visa Waiver Program may use VWP if:

...................................(yadda yadda)

They have complied with the conditions of previous admissions under the Visa Waiver Program, and have not been found ineligible for a U.S. visa;
