Flight stopover in the US?

Hi there,

I'm a Canadian Citizen and my Husband is an American Citizen. We applied for our k-3 visa back in October through a laywer. Our lawyer advised me to stay in Canada while our visa is pending and not travel to the US so my husband has been coming up to Canada to visit me in the mean time. We have a wedding to go to in Austrailia in September and although we are hopefull that we will have my visa by then, we are trying to play it safe and get our facts straight before we book our flights. Its much cheaper to fly from Los Angeles to Australia than it is from Toronto (nearly half the price!) so my question is, if I get a flight from Toronto to LA, and then from LA to Australia, is there going to be a problem "stopping over" in the US if I have to go through border patrol to switch terminals? Anybody have any insight? Arent airports international ground? I wont be leaving the airport... I hope I've made my question clear enough. Any help would be MUCH appreciated! Thank you!

Thank you for that FAQ page, very helpful! I've finished school and I work for myself so I'm not too sure how hard/easy it would be for me to travel. I have an apartment here in Canada but the lease name is under my dad...

I don't know how it goes with canadian citizens, because of your good diplomatic relationship with the US

everyone else needs a transit visa

I wanted to transit through the US to go to Holland in december, so I could do the second part of the flight with my husband, but I decided to just fly straight to frankfurt... the US is just too much hassle... didn't want to end up in a cell getting a cavity search or anything

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

not to worry, I have flown to see my husband 4 times now and I've never had a problem. I take copies of all our documents that we've submitted for a visa as well as my rent receipts, letter from employer, my son's school enrollment form, bills, anything that shows a tie to Canada...so they know I'm not planning on immigrating illegally. The worst one is Calgary, but if you're flying directly to LA from your airport, you shouldn't have any problem. I plan to be completely honest if they ever ask WHO are you visiting in the US...NEVER give them more info than necessary. If they ask what your purpose is, I always say just visiting and that's it. I'm always calm, never letting them know that I'm actually nervous as they can possibly turn you away. Have a great time in Australia!

there is no legal reason why your lawyer should have told you to stay in Canada for the duration. Canadians are allowed to visit the US even if/while an immigrant petition is pending. You just need to show proof that you do not intend to stay illegally to get around the immigration law. If you're just on a stop-over and have a ticket for a flight to Australia, I imagine that should suffice (no transit visa required, Canadians do not need visas to visit/transit). Also take along the wedding invitation to show that you are in fact expected to be in Australia at a certain date, and if you have ANYthing that can prove you will be returning to Canada after that, bring it. Copies of bills in your name, even copies of your US immigration paperwork to show that you are in fact "doing it the legal way".
