We went to the SSA office this morning.

My spouse wanted to change her last name(based on marriage) and was basically told that since she entered the country on her maiden name, her case/file would have to be sent to DHS for verification and that it would take 4-6 weeks.

Based on what I've read on this forum that doesn't seem to be the case. Some of the married couples have gotten their SS number fairly quickly(within 2 weeks) so what gives?

Note: You will need to show the original certified copy of your marriage certificate..

That's BS if her status verifies with her maiden name. I would go back to the office and ask to speak with the office manager and show the following:

RM 00203.210 C. Procedure - Immigration Document as Evidence of Legal Name

When an alien applies for an SSN card, SSA presumes the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

In some cases, the applicant may have changed his/her name after DHS issued the immigration document (e.g., he/she has married and is now using the spouse’s last name) but does not present an immigration document showing the new name. In these cases, the DHS system reflects the new name only when the person provided the name change information to DHS and requested to have his/her immigration record changed to show the new name. When the SAVE query response shows the old name that is shown on the immigration document presented and not the new name on the identity document presented, do not consider this a name discrepancy for enumeration purposes.

Be sure to take her I-94, passport and marriage certificate into the office.

Sounds like ####### to me too.

I went in with my marriage cert because like your wife, I was applying in my married name. I brought my passport (in maiden name of course) and marriage cert only and we were out the door in a matter of 5 mins, no complications frankly.

Is the AOS not filed under her married name? If not, I can see how things become a little confusing and perhaps that causes issues. Although I went and got my SSN before my AOS NOA's even came, not really connected.

we all know thats Bull , but well unfortunatly a lot of SS offices got people working for them who think and belive they know everything ,

i went trough the same Bull , went there 2 times talked to supervicers just to hear they will send a request of status to DHS wich should take 4 - 6 weeks till i hear something ,

I got frustrated cose I did show them every legal print out I could find here as well as from google ( had over 5 print outs showing K1 are able to get SS) , so had to waite ,

but waited only like 2 weeks then wrote a nice lil very polite but right to the point complain letter about my local office to the head office of SS administration , also calld them complaining about my local office had my SS# approved a week later and in mail the following week after the approval

what I would do print out the document the previouse poster gave , with the rules on name change based on marriage , as well as every document you can find reguarding K1 SS#

After a brief arguement with the SSA clerk, we applied for Marlene's SSN in her married name using her passport/visa/I-94(maiden name) and our certified marriage certificate.

That's what we did...I tried explaining to the person that my spouse entered US using her maiden name but by virtue of her marriage, she changed her last name and now wants to apply for SSN based on the married name..the person at SSA wasn't helpful.

We decided to apply for the SSN based on the married name and wait it out until it gets thro' DHS.

Note: We could have applied based on the maiden name(and perhaps received the card sooner) but then this will require another visit to SSA to change to the marriage name..

Well, I am glad that that you'll get some kind of SSN card then.

Will the EAD be in her married name? Guess you'll have to bring the marriage cert along if she gets hired before getting a new SSN with the married name.

Your problem was a little different. In your case the office thought you no longer had K-1 status after getting married. In this case they aren't questioning the status still being valid, just the name in SAVE must still be her maiden name. Hopefully, with what I provided the office will see the light and process the application or they won't BS around until her K-1 status is within 14 days of expiring.

I went to SSA on February 7th to change my name (I already had SSN even before my K1 visa) and I was told to wait for about 2-4 weeks because they had to verify my status from immigration. I hope I get the card soon so I can change my name in my driver's license too.

I had my name changed done right after we got married and took only 1 week for the card to arrive in the mail.

We received the SSN card in the mail today. :thumbs: ..took about 22 days..It had *valid for work with DHS authorization*
