Hello all,

My wife if from France. We married on November 2007. She has not worked in the USA. Our applications with the USCIS are in the review process so she does not have a SSN yet. We are filling our tax return for 2007 in the USA. The IRS has told us to either file an extension, file separately, or use 1040NR. Turbox tax online is just as confusing as the IRS agent service reps.

Does she pay taxes to France and the USA for her income in France?

What forms do we use?

Your suggestions are greatly appreciated!

I know by now you've most likely found an answer to your question. But this is what we were told. If you're married to a U.S. citizen you must file and pay taxes in the U.S. even if that means you pay taxes in the U.S. and France. You can however claim the foreign earned income tax credit so you don't pay double tax.

If the non-U.S. citizen doesn't have a SSN he/she must file for a Tax Identification Number. You can file for an extention in hopes that she'll get her visa and thereby SSN in time to go on the tax return.

Either way no matter what she does, she must file a tax return in the U.S. for 2007. (unless her french income falls below the filing requirements).

As a note: this is what IRS in London told us. We were facing the same problem for 2006. Thankfully my income was below filing requirements so my husband (USC) was the only one that had to file. On the return he just put 'married filing seperately'

Jan 05, 2007 - Filed I-130 at the US embassy in Copenhagen (Approved)

Jan 30, 2007 - Received e-mail from embassy, I-130 has to be re-approved in London, we both need to file G-325A

Jan 31, 2007 - G-325A sent to US embassy in Copenhagen

Feb 15, 2007 - OP-169, DS 230 I & II, I-864 sent to US embassy in Copenhagen

Feb 27, 2007 - US embassy Copenhagen, I-130 re-approved and back

Mar 03, 2007 - Receive packet 4 - interview date April 12th

Mar 06, 2007 - Call from embassy - interview date is now on March 8th

Mar 08, 2007 - Interview at embassy - Visa approved IF medical report is all clear

Mar 14, 2007 - Medical exam

Apr 07, 2007 - Visa packet received

Apr 17, 2007 - POE Newark Intl. Airport

Apr 23, 2007 - USCIS refuse to change my mailing address

May 07, 2007 - Re-file for SSN

May 10, 2007 - USCIS receive visa packet from Newark

May 11, 2007 - Gets SSN

May 19, 2007 - Receive SS card

Jul 10, 2007 - Receive letter from TSC: greencard returned by post office - will re-send (duh!!!)

Sep 17, 2007 - Receive Welcome Letter

Feb 01, 2008 - Gets NC License - DMV will only issues it until Apr 17 08 (expiration date on entry visa in passport) since greencard not in hand

Mar 06, 2008 - After 10 months and some change GC FINALLY in hand!!

Apr 17 - Present: USCIS has managed to switch my case # with some else, send my greencard to the wrong address and had to make 3 - yes 3 - service requests on sending out my card

Yes she files in France for the income she made in France. For the US part I'm not sure. I filed here but I worked before October. It's usually to your benefit to file together anyway.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship
