I-130 approved, I-129F pending

Hello everyone,

I want to start this thread for those who have gotten their I-130 approved but still waiting on I-129F to get approved. My I-130 was recieved by CSC on Aug 1st, 07 and approved on Jan 17th, 08. I had waited to recieve the NOA1 for I-130 before i sent I-129F. My I-129F was recived by CSC on Aug 16th, 07 and still has not been approved. The online case status does show that I-129F was touched the day they approved I-130. I called the customer service line today and they told me that they usually don't grant K-3 visas to benificiaries whose I-130 has been approved since K-3s are only issued to bring your spouce here while I-130 is still pending. When I asked the customer service rep that, "Does this mean my I-129F has been cancelled?" she said, no it still shows as pending on thier system. I do not know what to think of this. It almost seemed like the USCIS does not approve I-129F if they have already approved I-130 for the same applicant. Does anyone have any further information on this? It will be 6 months since I filed I-129F on Feb 16th, 08. I plan to call the customer service again to put in a request to update me on the staus of my case since the NOA1 for I-129f states that we shoudl contact them if we don't hear anything back within 180 days from the date the application was filed.

It would be nice if I-129F got approved coz the timelines on here show that it is taking about 4-5 months for spouces to enter US from the date of approval at USCIS. Please post information if you know more about a situation like mine.

That's great for you that your I-130 got approved so fast!!! I been waiting since 2006

But I did call USCIS today, my weekly call to them, and this nice lady advised me that the reason why K-3 visa are being cancelled in general are because the State Department are in fact all caught-up with processing I-130's and both the I-130's and K-3 visa are taking the same time to be process. And if they feel like your I-130 will be approved about the same time as your I-129F, they rather choose for you the I-130 and save both time and money. This of course was what she explained to me... She told me that NOT everyone at USCIS was aware of this process and that finally they are starting to find out the correct way the "HARD" way. Of course still no status on my case but she promised me that she would follow-up with my adjudicator and call me back… Well I am still waiting for this call from 3 weeks ago… I am still trying to be patient!! So you see you are lucky that your I-130 got approved so fast!!!

Hello, newbie here :) I have a question with regards to an approved I-130; if USCIS cancels your I-129f or says it is "pending", what are your options? I'm still new at all of this (my husband will file the I-130 soon). If we apply for the I-130 and it is approved within months (high hopes), is there a way to obtain legal entry into the U.S. and then file an AOS? Is that where the CR-1 comes into play?

Sorry, many questions...I've read up on everything but am still confused. Sigh.
