Hello All,

I am not able to get anyone to provide information regarding filling for Spouse Visa through DCF India... I have read all information I can, and forums and it seems no one here has applied through DCF, New Delhi..

If you know someone who has, and/or if you have please guide me through process...

I have even called few lawyers in my area, but they are not able to apply through India.. According to them, Delhi does not take spouse visa application here, or you have to be married for 6months in order to apply in India... - - I know these statements are not valid as per my research..

I have called the embassy several times (they are only open from 10am-12noon) and number constantly is comming busy..

do you know if there are lawyers outsid ethe embassy who gives advices and are they wise?

Hi Sahana,

Welcome to VJ. We my personal experice with Delhi was that frist yes there is a minimum time that you have to have been in the country and that is 90 days anything above that the better but that is the minimum.

Also, you must provide residency information I.e FRRO is the best, Utitly bills, Affidevets from neighbors, Indian Drivers License, Indian Bank Account with indian address, anything else the says or that can prove you have been in india for awhile and plan to be there for awhile.

I did not use a Lawyer but did go to the USCIS in delhi and talked to them there I found them to be Very Helpful Citzens don;t have to wait in line untill you get to the back room and even back there the wait is not bad. Go at 10am best time I found.

Hi Sahana,

Welcome to VJ. We my personal experice with Delhi was that frist yes there is a minimum time that you have to have been in the country and that is 90 days anything above that the better but that is the minimum.

go for it Sahana, if you can afford to stay in India during the process, its worth the journey and time. I'm sure if you had Indian roots, you would enjoy your time out there. For me i would be packing my bags for good next week.

Bring all proofes of residency A filled out i-130 & G325 for you and you spouse Marrige certifacate Supporting papers of Marrige i.e affidavites joint bank accounts etc. Be sure to bring lots of good wedding pics orignals I remember someone being reject because they did not do that.

I am surprised you have not received the case number yet, if their is a walk in interview shouldnt they be giving you the number right ahead...

Anyways, OCI Card is basically like a dual citizenship for India.. I do not have to register with police if I stay here for more than 3months, I can work, own property in India...

I am surprised you have not received the case number yet, if their is a walk in interview shouldnt they be giving you the number right ahead...

I am aware that from my spouse end I only need to submit (passport, birth certificate or school certificate along with passport size photo and his G-35A form)

I I submit passport right now, in future do I have to submit his birth certificate at all???

the reason I am asking as my spouses birthdate is not same on passport and birth certificate.. all his offical documents have one birthdate and just birth certificate has the other birthday...

I wanna know if the embassy would ask for the birth certificate?

Actually, for the I-130, my husband used his 10th Standard Certificate. For the actual visa, we need to provide his Birth Certificate...

After 3 months of marriage have finally applied for hubby ;-)

Here is my story:

Arrived via morning flight to Delhi at 9.30am.

Reached Embassy at 10.00am

At the entrance my passport was checked, the guard matched my passport picture to me!

There were 5 lines, one designated to each kind of visa, we were requested to go on line 5, which was for American Citizen Services. We proceded towards the window, but were then informed that we can directly go inside the office. "No Cellphones & Camera allowed" hence submitted both our cellphones and camera to the guard.

Once inside the embassy our name was collected and the reason for our visit was noted down by a guard.

About 2-3 minutes later the guard came with a red badge stated "Escort Required" and escorted us to a back office. The back office was small in size, with restrooms, and one small window connected to inner office. Their was one couple ahead of us for the same purpose. After their turn our names were called and we headed out to the counter. We provided a applicant bunch which was provided by below covering letter:

The executive at the window was really helpful. Their were 2 errors which we had made in our application which she made us correct. While reviewing our application she asked us following questions.

1. When did I arrive to India?

2. When did we get married?

3. How many guest were their?

4. Who in family members were their at the wedding?

5. Did we know each other before we got married, hence arrange or love marriage?

6. When did we get married?

7. What does my spouse do India?

8. What kind of business?

9. Both of our birthdate were confirmed

10. What do I do in India?

11. Asked us for wedding photos (we had taken bunch of pictures, but are required only cermoney snaps, the executive took about 10 pictures from our wedding)

At same time, I asked her how long the procedure will take -- her answer about 2 months

I asked her if she is aware of my return to US is mandatory within certain limit time - - her answer was no, since I have an OCI card I can stay in India as long as I want without informing anyone..

Exeuctive asked us to pay $355 at the cashier window at front office, and gave us a packet 3.5 which we can submit to Ahmedabad, Mumbai to their Delhi office. "The faster you send this, the sooner your interview date will be".

We were then escorted to the front office (our red tags were taken from us during this time) to the cashier (window 7) where we paid $355 to the cashier. Once we received the recepit we headed out of the office.

After collecting our phones and camera we were on our way to HOME...

Overall, it was a fast procedure (do know why I waited so long!) iit took us about 45minutes.. we were our by 10.45

Currently will fill the packet 3.5 and send it accorss...

Iam a USC and have applied for I-130 in January 2008 through USCIS for my spouse. Based on the lengthy timelines I have decided to do a DCF from New Delhi.

I will be working for sometime from my company's India location to take care of this.

I will apply for a employment visa to work in India for 1 year. Will that be ok? Just curious if they have any requirements like OCI or any other long term visa to show long ties in India in the consulate?

I know I need to cancel the petition thats already being filed.

What type of proof they need at the consulate that shows I have cancellled my I-130 filed form the US.

Also are they strict about the 90 day residency requirement or anything more than 2 months should be ok?

I really appreciate any help!

I really appreciate any help!

I could be wrong, but it may actually slow your process down to go through DCF Delhi... Of course, that would all depend upon the length of time it would take you to get everything set up through your company and actually get to India... I could be totally wrong, but I thought the residency requirement was 6 months now, rather than 90 days, and they seem to be sticklers about that, but others may be able to tell you a different story. It just seems like it would be a lot of extra hassle, and TIME to get everything going, spend the required 6 months here, and then apply for DCF which seems to take 2-3 months from the time of submission of the I-130. (I can TOTALLY understand wanting to be near your spouse for that time period though!!)
