As part of the K1 guidelines it is recommended to submit "Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it."

Now I met my fiancee while I was separated from my ex-wife for a year and 6 months into a divorce. Should I mention this? If I don't mention it in the declaration letter will it raise flags as to why I was meeting someone when I was still married? I have 2 versions of a declaration letter, one with mention of the divorce, and one without. Basically I explain the divorce that we were separated due to job requirements and she filed for divorce 6 months into our separation, and 6 months after her filing for divorce I met my fiancee. I go on to explain my meetings with my fiancee and the date of my divorce. Do you think it is necessary to explain this or is the divorce decree enough in itself? Or will it raise red flags or an RFE if I don't explain?

There's no need for a separate attachment. Any number of us used the space provided on the form.... which is a good indicator of how much information they want. We put down something to the effect of....

"Initially met in "place" in "month/year". Ongoing relationship from there."

no need to go into details on your divorce , as long as you are divorced when you file

( since they required a copy of the divorce cert from eather one who was previously married )

just write a few lines concerning your relationship with your fiance and how you met

I used the space provided in the adobe reader layout... jsut like 5 lines of the meeting. If was supported by an affidavit and we had passport stamps sprayed right around the dates as well.

From the evidence they can paint a pretty clear picture of how often you saw eachother and when

If you're already divorced, they don't care about your ex-wife. It's the relationship with your fiancee that matters and that's what they want to hear about.

Here's a thought - you can also use this declaration to make a nice statement of your love and commitment. That's what I did and mine would bring tears to your eyes. :)

We had the same situation as you do but Jason did write an explanation on a separate attachment. We wanted to be as honest as we could. The explanation wasn't long but we wanted them to pay attention to that moment. So i suggest that you should do the same. It won't hurt you anyway.

01 Jan 07 - Jason travels to Moscow for 2 weeks with Sasha

27 May 07 - Jason again travels to Moscow for 2 weeks of perfection

14 July 07 - I-129F and all related documents sent to VSC

16 July 07 - I-129F delivered to VSC and signed for by P. Novak

20 July 07 - NOA1 issued / receipt number assigned

27 Sep 07 - Jason travels to Moscow to be with Sasha for 2 weeks

28 Nov 07 - NOA2 issued...TOUCHED!...then...APPROVED!!!

01 Dec 07 - NVC receives/assigns case #

04 Dec 07 - NVC sends case to U.S. Embassy Moscow

26 Dec 07 - Jason visits Sasha in Russia for the 4th and final time of 2007 :)

22 Feb 08 - Moscow Interview! (APPROVED!!!)..Yay!

24 Mar 08 - Sasha and Jason reunite in the U.S. :)

31 May 08 - Married

29 Dec 08- Alexander is born

11 Jan 10 - AOS / AP / EAD package sent

19 Jan 10 - AOS NOA1 / AP NOA1 / EAD NOA1

08 Feb 10 - AOS case transferred to CSC

16 Mar 10 - AP received

16 Mar 10 - AOS approved

19 Mar 10 - EAD received

22 Mar 10 - GC received
