My girlfriend has been coming and going from the US on the VWP for about 3 years now and finally was denied entry. Unfortunately shes now banned from using VWP and isn't likely to be approved for anything other then a fiance visa...so as you may guess this is what we have decided we wanna really do.

Now enough with the rambling and to get straight to the issue...I am 20yo and a small business owner on the internet over the last 3 years. I have never filed a tax return due to poor organization with my business and some various set backs that prevented the payment of taxes. At the moment we are working to properly structure the business such as incorporating and starting to set aside what we will need to pay taxes. Unfortunately at the present time I believe I will owe more in taxes then I even have, so simply paying late wouldn't work out too well.

Now my dad who has had a stable job and income for the last 35 years has offered to be a co-sponsor, but would it be at all advisable to even file for a fiance visa with the tax issues taking place? is there any way around it?

U can still use ur Dad as a cosponsor as long as he meets the above poverty level criteria and apply 4 the k1. There are ppl who are in b/w jobs or in debt who used cosponsors. From my understanding, in instances where petitioner is on govt welfare they can be denied even if they use cosponsor. Good luck.

I would use your dad that is the best thing since you have no Tax returns.
