My wife and i went for AOS interview yesterday.everything went on fine.my wife is the petitioner, her income for 2006 wasn't up to the required amount so we had to get a joint sponsor who met the requirement. The IO for some reason wanted to see my wife's w2 for 2007 which unfortunately we had left in the car to be able to calculate if the joint sponsor would qualify.this sounded strange cos i thought the essence of the affidavit of support is that the joint sponsor accepts legal responsibility for financially supporting the beneficiary and not the petioner.so correct me if i am wrong but the us spouse is not a dependent on the affidavit of support. the IO seemed to be a new guy or something cos he had to refer with this lady who seemed to be his supervisor from time to time. so i was trying to explain what i thought about the essence of the affidavit of support, but he seemed kinda confused and whats explaining things in a way to mean that they take into consideration the total number including my us spouse as dependents. now he is asking us to send my spouse income taxes for 2007. this whole thing buffles my mind. does this mean i might have to look for an additional sponsor since my wife's income for 2007 didn't meet the minimum requirement for 2007?

So?

That doesn't mean the USC spouse and the legally employed immigrant would not qualify together on a new affidavit.

I know he didn't. I asked him if he's working. I don't know why the AO did what he did. I'm not even clear what happened during the interview. I'm trying to help answer the question.

Do you and your wife live in a different residence than your sponsor?

If so, your wife needs to file her own I864, even if her income is insufficient.

The joint sponsor files another I864 of their own.

Each sponsor needs to show the most recent 1040 (tax return).
