birth certificate same name different date of birth

i know a friend who filed for CR1. the hubby has two birthdates. when he went to work abroad, he made himself a few years older, applied at nso for late registration and got himself a passport. when they got married, the hubby used the birthdate (the one which made him a few years older) instead of his true birthdate in the marriage contract. the hubby said that when he requested for a BC at NSO, the BC released was the one which made him a few years older.

question:

will there be any problem in the future? the BC used in applying for CR1 was the one which makes the hubby a few years older.

will there be any background investigation especially that the late registration to make the hubby a few years older was only done a few years back? will the USEM check school records? if they do, they will surely discover that the birthdate he used in the BC which was submitted was not true.

will the document verification at NSO reveal that the person have two BC with different birthdates and all other details in the BC are the same?

any thoughts on this is highly appreciated. thanks!

Wow!that's its very complicated..i would say "Yes! so that's why USEM enforce the document verification because of things like this happening in the Philippines..also, it defends how they verify it..because, i think, when they try to put entry on the computer, they will put the information "NAME and the BIRTHDATE and BIRTHPLACE" of the applicant..of course, it will shows only one person has that name and birthday...that's how they look in info before..i don't know now..it may be have some changes..how i know it before,? i have classmate in high school works in NSO office..i wish i still have contact on her and ask things like this..anyway, just a thought!

The NSO will only have the copy that was forwarded by the LCR. If that was the original and the real birthdate, then that's the one NSO will follow and have in their data bank.

Regarding the late registered BC. If this was done within the normal process: Like coming from the LCR and properly endorsed to NSO as late registered, then this will appear at NSO. They can get the late registered copy with proper "annotation" written on it that it was "late registered". For this case, the applicant have to go to the NSO Vibal Building in QC corner EDSA (not the main NSO building in QC) to get the annotated document. But the applicant can only get this copy if he had an endorsement letter from his LCR.

Having 2 BC's with different birth dates and doing so for "fraudulent" reasons like you mentioned (to work abroad) "MAY" not look good for USEM/USCIS. This "may" cause a "red flag". It would be better that he use the one which is his real BC (the correct birth date) and probably not to mention that he "lied" with his age and used "fraudulent" means (acquiring documents) for personal benefits like working abroad. Although this does happen in the Philippines, doing "fraudulent acts" will be a big issue with USEM/USCIS.

I have a friend who had applied and had some "fraudulent documents" (not of his knowing but done by his employer/agency), he had applied for immigrant status to the US (as RN) and had been denied 2x and banned to enter the US for life.

I hope things will work well for your friend. God Bless.

thanks a lot for the inputs vsmtghdy and sofia2009. i hope everything will turn out good for them despite "this." we tried our best to explain the possible consequences to her before filing the CR1 at USCIS but she was quite stubborn. :luv:(F)
