I been in US for over a year now, and i have a Green card but my relationship to my husband is not really good, we have a big differences, he dont want us to have a children which is the most important thing to me,

What i want to know if i still have a chance to come to US if i divorce my husband? or Do i still have a chance to become a US citizen even if we are divorce since i have a greencard? he is not really abusive but some big differences and especially of having a kids, he dont like a kid, and if he want one he said when my age is about 35 or 37. i love children and i beileve a family will be called a family without them.

Hope things will still work out.

I believe, but you should get legal representation is that if you have permanent status, you can stay. But I would get legal advice because if we give your wrong answer, you won't be happy if you have to leave.

I think you can remove conditions if you are divorced. I am sure someone else here knows for sure.

As far as the kids go, didn't you discuss this before getting married? It was one of the prime topics for Claudeth and myself.

If you are able to or already have "removed conditions" from your greencard there will be no restriction to citizenship except time..... married to a USC, citizenship was possible at or after 3 years permanent residence.. not married to a USC, citizenship is after 5 years permanent residence

What type of Green Card do you have....the conditional (expires 2 years from date of issue, have to remove conditions) or the permanent 10 year card?

With either, it is possible to remain in the US and attain citizenship, it just depends on how you go about it. If you have a conditional card, you will have to remove those conditions to your residency begging 90 days before your card expires. You can do this if you are divorced...you just have to prove that you entered in your marriage "in good faith".....so you will need documentary proof of a real marriage, and documentary proof of marriage termination.

If you have permanent residency(10 year card)....you don't need to do anything, just wait until you have been a resident in the US for 5 years and apply for citizenship.

On the having kids issue....I'm w/ the previous posters, did you not discuss when and if you will be having kids, before you got married? Is this a case of one thing was agreed upon by both parties before the marriage, and now one or the other has changed their minds?

If the alien has a divorce decree, she does not have to wait until 90 days prior to the expiry date in order to remove conditions.

Many people change their minds about children. A USC spouse saying he does not want children doesn't mean it was never discussed.

Oops my bad...I thought you would still have to wait out the 2 years as stated on the LPR card. Thanks for correcting me. :)

Read my original statement. I asked if it was discussed, OR was this was a case where one thing was agreed upon before marriage, and now one or the other has changed their mind. Not that it matters in the long run....other than for the grounds of divorce, which is not the topic of this forum or VJ for that matter....it was just a personal curiosity. :blush:
