First post on VJ folks so bear with me if this was answered before.

Just got married yesterday here in Bolivia, planning on filing I-130 for my new wife next week when back in the US. Muy new stepson is still 17, so I'm planning on filing an I-129F for a K3 for her and a K4 for him after my NOA1 on the I-130.

I can't figure out, after talking to USCIS and looking at this website, if I have to file a SEPARATE I-130 for him along with the original I-130 for my wife, or just list him on her I-130 and then file for his K-4 on the I=129F.

If anyone has a clear answer, it would be most appreciated....

All you have to o is list him on the I-130 and list him on the I-129f (which is used for k-3 and k-4 visas). They will go to the interview together.

Follow up appt.: 04/24/08 12:30pm .... they are saying its a 2nd interview (APPROVED)

That's one option that at least used to work. The whole viability of K3 and K4 is pretty iffy right now. It seems USCIS is simply approving I-130 petitions and cancelling the I-129F's filed. This is really bad for some people.

Eventually, however, each step-child coming on a spouse based visa, will need their own I-130. You can file it now or file it with their AOS after they arrive on a K3, again, if that's even a possibility now. I recommend filing it now for three reasons. First, there may be now viable K3 or K4 anyway and second, it will speed any status adjustment process to have the I-130 already approved. If you don't file an I-130 for a child and the K3 dies an early death, you'll be faced with filing the I-130 and either waiting for the child's petition to catch up or leave the child behind to follow later.
