HELP: How to overcome public charge

Hi,

I have been reading this public charge issue throughout the site but my situation seems to be different than others.

My story:

I have been interviewed late last year but the consulate told me that she cannot grant me a visa due to public charge. I have all the necessary docs for the k1 application but my fiance's earnings is not above the poverty guideline. He is just starting to build his business and so as expected, it is not getting that much income for now. I was told that I can go back anytime without appointment to the embassy as long as I bring the paper (that states that I will most likely be a spublic charge) and proofs to overcome public charge.

His stepfather though volunteered to be my sponsor. He filled up another I-134 and some legal documents that states his income and his assets. I plan to go to the embassy tomorrow to submit those to window x.

My questions are:

1. Are those documents enough to get my chances of being approved increase? Did I miss out any other docs to submit?

2. Will I have to pay? How much will I pay?

I would appreciate your responses regarding this matter especially from those who have experienced the similar situation.

Yes, assuming your fiancé's stepfather meets the requirements of the I-134 (which is judged like an I-864), your odds will go from 0% to 90+%... It sounds like this document is all you need, but make sure you have plenty of evidence of income (tax transcripts recommended)

2. Will I have to pay? How much will I pay? There is no filing fee for the I-134

Apr 26, 2008 -------> Wedding

Apr 28, 2008 -------> Filed (forms mailed)

Apr 30, 2008 -------> Forms received by USCIS

May 06, 2008 -------> Cashed check posted to account

May 10, 2008 -------> NOA1 received for EAD, AP, and AoS

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

Jul 14, 2008 -------> EAD and AP received

Jul 17, 2008 -------> AoS approved (card production ordered)

thanks for the quick reply, jesse g :) I checked again the docs and here's what i have:

1. filled up and notarized I-134

2. company letter (with letterhead) where he works that states his position and his rate per day and per year

3. a copy of his retirement plan

4. mortgage payments

5. w2 tax form / form 1040 - tax

6. letter from pension commission stating how much he is entitled to receive per year

i was nervous and scared during my 1st interview, when i didnt get approved, i told myself that i will no longer do that but..here i am again..hehe

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!
