Hi,

I had an F-1 visa for study at the University of South carolina. I went there and attened school as required. I did miss school for a year in 2005 but then I returned to school for another year before coming home for chrsitmas in Dec 2006. Home is the UK by the way. After being denied entry at atlanta in Jan I was told that I need to get a new F-1 visa and my application for admission was withdrawn. I applied for a Visa in London on March 2nd and got denied under 214b. So with more evidence of intent to return to the Uk in hand, I tried again this time in Belfast and this time I was told that I was going to be refused a visa and I may be subject to a 3 year ban from the USA but she didnt know and that she (consular officer) was sending my case to different Agencies in the US for information about me. Sounds scray to me but I have had no trouble with the Police in either the UK or The US so I don't know what that is all about. Anyway she gave me my passport back but took my I-20 form.

This paperwork from the US could take forever to get back to me. What should I do? Should I file the a waiver form? If so which one? I do not have any family in the US all I want to do is complete my degree. At my first interview in London he did say something about a waiver but did not give me specifics. Can I file this for study or at least to get to the States to recover belongings? Please give some advice. I feel like I did more than enough to overturn the reason for denial in London under 214b. Any help would be most gratefully received. HELP!!!!

Well it's always a chance they will approve you but better be safe than sorry and go ahead and prepare your waiver so you can turn it in to them at the interview in case it goes that route.

Did he get convicted? I am sorry I cant be of much help as I dont know much about the UK laws.

As for the waiver part..

Do you have community ties?

A desire for an american education, student loans, debt?

When I wrote my waiver I was based in Sweden living with my then spouse. I compared and contrasted and made my case for the worst possible outcome if I didnt return to the US. Although our situation was far more complex and we had children.

Dont worry, it will turn out just fine I am sure! :)

You can always go to Immigrate2US to see some waiver brief examples relating to the UK. (I hope I didnt overstep my bounds with VJ there..) :unsure:

i've been to immigrate2us, but for some reason the vast majority of the threads won't download properly and i end up with one line repeated over and over...very annoying because it seems like there is some very important information over there!!

he was convicted and fined, did no jail time and the amount he was caught with was significantly less than 30g...since then he's quit smoking pot, has been employed, is active in the community (as allotment warden) and has had no further problems with the law...

i have tenuous ties to the USA: i have no family, but very close friends that i consider family, including a friend who is disabled and over 70, and a beloved godson who is 14...i know the immigration people won't understand this, but they ARE my family, since my own family died when i was 22 (22 years ago)...i already have a college degree, so no educational needs, but i have some significant health problems (ovarian cancer and diabetes)...however, i receive care here in the UK through the NHS, so i can't see how i can prove 'extreme hardship'...

the only thing i can think of is to try to impress on them how isolated i am socially, how dependent i am on my husband for care and many other aspects of life, and that we are financially stymied here and would be considerably better off in America...does that sound like enough????

i'm frantic; i haven't slept in days, and i'm terrified i'll end up having to stay here in the UK for the rest of my life...

6 years, and i have permanent resident status...i hate it here and i want to go home so desperately; i can't see my life being worth living if i have to stay here, even with the love of my life (Paul)...but how do you prove that to a bunch of bureaucrats sitting behind a desk at the embassy? i haven't consulted my GP about it but maybe i should, if only to get a letter saying i'm unstable mentally:)

the problem is that i'm safe, i receive health care, i'm financially stable, i have housing and a job, but no friends, no social contacts, and i'm miserable here...where do you find documentation that says i'd be happier at home?

Anna I would assume he will need a waiver. It sounds like he has reformed his life quite a bit. I would get him to write a letter on his own behalf explaining his reasoning as to what was going on his head when these things were occurring. Also get some of his closest friends and perhaps his employer to write some character reference letters on his behalf.

You brought up a good point with your elderly friend you are close to. Do you provide care for her/him? If there is really no one caring for them and you seem to be it, then use it in your brief. Use the financial argument although that alone isnt enough according to guidelines.

Use your medical conditions and explain fully what can happen to you. I think you really need to focus on his reform.

i've read the same thing, Mrs BB, but it can't hurt, i don't think

as far as immigrate2us is concerned, i have been to the waiver section many times, hoping that they will sort our the problems, but i still can't download anything of any use; i would dearly like to read the samples of approved HSLs, but i get to about 2/3 of the way through the first one (that doesn't apply to my problem but is still useful) and it starts just showing a big grey block where they text should be...this same thing has been happening since i joined in Oct...i'm beginning to lose hope!! LOL

i've been talking to some folks who are helping me gather arguments, and i think i'm going in a productive direction...i'm going to use my health, my social isolation and dependency on my husband and mental status, the NHS and its multitude of problems and shortcomings, my elderly friend back home (who is also my husband's sponsor), my godson, and our financial situation (not being able to afford a house here but being able to in the US)...i can only hope that's enough for them to allow him in!

Have been looking for a forum like this for a while now. Had an interview at the Embassy in London and told to file I-601 waiver. The Embassy told me not to use a lawyer, everyone else is telling my wife and I that we should - everyone has an opinion , right? What are your experiences with this? Lawyer or no lawyer?

That's a hard one to answer. It all depends on your situation and how comfortable you feel about writing your own letters. We did our letters ourself and when my husband went for his interview the officers who was interviewing him made the statement that it was good we wrote our own letters. He said that USCIS preferred them in our own words. Not sure how much water that holds since the officers who interviews is not the person who decides if the waiver is approved or denied. Our waiver was approved after over 20 weeks of waiting, but I think it all boils down to the reason you were denied and how strong you can make your hardship letters. I don't know if you have been told yet, but London requires a letter from both you and the USC.

we had planned on including a letter from the beneficiary and the USC anyway, if only to show remorse and rehabilitation from his crime...we have a telephone consultation with laurel scott, a US-based immigration lawyer, tonight, so the questions are mounting up :) hopefully she will know if it is preferable to do the HSL and waiver yourself or get a lawyer to help with it, and she can give ideas what to include in the HSL.

Sorry Angela I didn't mean to cause you worry. It's been almost a year since we filed our waiver so maybe the requirements have changed. If not you can always write a letter up and send it over to London USCIS with your case number on it. We sent over more supporting documents after we filed our waiver with no problems. We made the USC letter more formal and my husbands letter was more relaxed. Showing remorse for what he had done and explaining the circumstances of what had happened. We pulled a few details from the USC letter and that was about it. I would imagine that if your case is still pending then you should have time to send them more documentation if you feel you need to.

You could also try emailing with full name, birthdate and case number. I emailed them a couple of times and they answered me within a few days. I never got a straight answer from them but they will reply.

It's ok, BaileyJ, I'm very quickly set off into panic these days... you know what I mean :blush: I'm probably worried over nothing.

I was thinking of emailing them about this, but I've been bugging them with emails over this Adam Walsh thing and the I-130 RFE weekly for the past couple weeks... in fact I just sent an email to them today bugging them about a decision on the I-130. I'd probably piss them off. I'll wait and see what my attorney advises, since I just emailed her about this.

Well I'm sorry if I got you upset. I know how all this waiting and worrying is. I just saw your post on the other thread and I see that you have had more than your share of problems. Waiting since Dec 2006? Good Grief. I thought our 20 weeks were long for us. I hope things start falling into place for you.

Thanks. I've had my I-130 approved and been to the Embassy twice already for interviews. The Consular Officer told me not to trust the hardship statements to a lawyer, but I am hoping to find one that has some experience with getting a waiver through the Embassy in London. I have no idea what constitutes extreme hardship.
