Duplicate NOA2 for AOS -7month wait

Hi everyone,

Q1 :wacko:

I have been approved got my visa and am now in the US with my fiance, soon to be married on Valentines day.

However we lost the NOA2 we got in NOvember, so immediately filed the I824 request for a duplicate (and another $340) which is what the lady at USCIS california told us to do. BUT now I am in the USA trying to file AOS and hoped the duplicate NOA2 would be through by now seen as how its been two months. (they cashed the 340$ check).

We called the USCIS helpline and they said it could take 7 months as that is the processing time reported on the website for this form. I explained that I think I need it for AOS filing and she was no help at all and basically all she said was use infopass to get an interview at my local office.

I cannot afford to wait 7 months for this without my EAD or AOS.Anyone have any ideas ?? :help:

Also Q2.

It says the EAD can be filed for online and the AOS has to be mailed. If the two have to be filed together is it possible to file one online and the other in the mail or will this just confuse them (given the joint filing fee situation).

02/05/2008 flew to JFK then onto Tampa (received EAD 90 days at JFK)

02/11/2008 applied for marriage license

02/14/2008 marriage ceremony

03/27/2008 sent application for AOS and 1 year EAD

03/29/2008 AOS and EAD Applications arrived at Chicago

04/03/2008 AOS and EAD NOA 1 Mailed

04/07/2008 AOS and EAD NOA 1 received in mail

04/07/2008 AOS and EAD touched and eneterd onto online system

04/11/2008 received bio appt for 05/06/08 at 11am

04/11/2008 National Center agreed to review reasons to expedite EAD

04/21/2008 *touched*

05/06/2008 Attended bio successfully

05/18/2008 received RFE for I-485

08/09/2008 mailed back RFE details

08/21/2008 phoned USCIS about I-765 being over 90 days - they hung up on me

*** 05/05/08 Times up for temporary EAD ***

You don't need to have or send the original NOA2; did you bring photocopies of your K-1 documents - you may have a copy in there somewhere...

If you can't wait for a duplicate copy, I would suggest emailing/calling the consulate where you had your K-1 visa approved and maybe they can fax/mail you a copy back...

You don't need to have or send the original NOA2; did you bring photocopies of your K-1 documents - you may have a copy in there somewhere...

If you can't wait for a duplicate copy, I would suggest emailing/calling the consulate where you had your K-1 visa approved and maybe they can fax/mail you a copy back...

Good idea but the consulates do not keep any documents... they package it all up and send it in the brown envelope....

thanks for all the help, we definitely don't have our copy in our paperwork as it was lost soon after receiving it.

I could print out the online status as being approved. However as you say I gave the big brown envelope pack to the officer at the POE.

Maybe if I make an infopass appointment and go talk to the local office they could help ?? what do you think ??

People have done this and it has worked in lieu of the actual approval notice... Get online, look up your case number and see if it is still there....

yeah its still there so I have printed it off now, We also spoke to the CSC and they said to fax over a letter asking for it to be expedited and the reason, then it should take about two weeks.

Don't know if there is anything else we can do really.
