In behalf of my friend she wants me to ask these questions here in the forum. I wanted to help her but I don't know the answers since I'm still in the Service Center stage.

Her situation is like this;

Four years ago she met (online) this American guy that is paraplegic. They fell in love & everything. He decided to petition her thru Fiance Visa & hired an immigration lawyer to help him waived the "meeting in person" requirement. She sent photocopies of her Birth Certificate & Biographic Data of her passport to the lawyer and of course Letter of Intent. She doesn't remember if she actually did fill out G-325A form. Anyway, her boyfriend didn't keep her updated about the progress of the said petition. A few months later something happened & sad to say their relationship didn't work. She is not sure if the guy canceled the petition or not.

Her questions are:

1. For DS-156 Ques #36 -- Has anyone ever filed an Immigrant Visa Petition on your behalf? Yes or No

What should be her answer? Yes or No?

2. What if the petition was as at NVC (stage) and forwarded to the Manila US Embassy before he canceled it. Would it still be in their database uptil now?

Would this cause problems if her current American BF files for Fiance visa for her?

So, if the new bf can petition her & their case is approved & reaches Manila US Embassy. For her interview, would the CO in Manila US Embassy closely scrutinized their case if she honestly tells them she doesn't know that the previous petition actually reached that said embassy? Would she be outright denied?

Hi... i think the answer to Has anyone ever filed an Immigrant Visa Petition on your behalf? Yes or No would be no, because a K1 visa is a nonimmigrant visa. Immigrant visa is the CR-1/IR-1. I have no idea how to answer your other questions so maybe other VJers will be able to help you.

30 Jan 2008 Touched - filing box here we come....

05 Feb 2008 Hard Copy NOA1 Received in Mail

03 Jun 2008 NOA2

10 Sep 2008 Interview 9:30

16 Jan 2009 Fly back to the USA

?? ??? 2009 Wedding Bells are Ringing

How about if u filed two petitions like I-130 and I-129f? and the DS-156 is for I-129F. right? what are u supposed to answer

For DS-156 Ques #36: Has anyone ever filed an Immigrant Visa Petition on your behalf? Yes or No

is it yes? because of the I-130 filed together w/ I-129F? and I-130 is immigrant visa.
