Tracking Febuary Filers

So after a week of waiting and calling....waiting and calling and waiting some more, I finally got through to the NVC automated system. They have no record of my I-130 meaning it hasn't been sent to them. Does anyone know how long it takes for the California Service Center to forward the case to the National Service Center? Or maybe a short cut to get them to do it a little faster?

On a happier note, Cody is expected to arrive on Thursday (May 29) but just found out from work that they are going to be closed till Wednesday morning so he doesn't have to work all weekend. He's now trying to move his flight so he can get here earlier cause Nikki (our daughter) has been threaten for the past two days to come early. I guess we'll see what happens!!

zawjatsaid - I'm guessing the RFE was for the fact that you didn't include your divorce decree in there. That's nothing too serious then and luckily you have an idea of what is wrong so you can have it ready to send back as soon as you get the letter. Keep us posted on how things go!

By the way what does "zawjatsaid" mean?

thank you I will keep you posted. I hope its that cuz I have a certified copy with me and can easily get more. I really hope thats it. They still havent touched the I-130. Zawjatsaid means wife of Said.

The embassy will just forward the I-129 packet to the foreign embassy and the foreign embassy does all the paper work. The I-130 packet stays at the NVC and they do all the paper work there.

In my case, I found out yesterday that the I-129 packet has been forwarded to the embassy in Mumbi.

Now, my wife just waits for the paperwork from Mumbai embassy.

So I just totally had a brain wave / shock / horror attack...whatever you wish to call it.

We never got a NOA1 for our I-129F application so maybe our approval of the I-130 wasn't actually a solo thing. Maybe we got both applications approved but since we never received the NOA1 and weren't able to track it and don't know it was approved.

They won't give us any information for the I-129F so I have no idea anymore!!

Could this be possible or am I just over reacting here?

Waiting for further instructions, also wondering if we should have filed I-129F as well.

i've been wondering the same thing about the k-3...but its too late now, well it would be a waste to do it now, and i'd be too scared it would slow it down

p.s you need to update your timeline, it says your k-3 but obviously from your post you only filed your I-130, which makes you a CR-1/IR-1 Filer

I got the RFE in the mail today, I sent a copoy of my marriage license in english but not arabic . So I will overnight that on Tuesday. I hope they hurry and finish my case once that gets there.

So wait you got an RFE because you didn't send it in Arabic? I thought that you were supposed to send everything in English. These people seriously confuse me sometimes!!

I know they are very confusing. but they stated that the english translation of a foreign document with out the foreign language document is not sufficient to establish a relationship for immigration purposes. Please submit the foreign language document from which the english translation was obtained. CONFUSING!!!!

Now that's just STUPID!!! It's a marriage license not a selection of emails. It says your husband and wife, no matter if it's in Arabic or in English. Sounds like they were just looking for something to be petty about. Did they say anything about the divorce decree?

If I gather correctly you only sent in the translation of an official document, but not the marriage certificate itself? If that was the case, then I'd say it's normal you got an RFE.

Immigration authorities need to be able to check whether there really was a marriage. A mere translation of something would not allow them to do that (because anyone could have written that).

Which is why normally you'd have to get the foreign document apostilled (here anyway), so that the other authority can verify its authenticity, along with a translation of the document and the apostille.

I know that our (Belgian) immigration authorities here ask the exact same hing. So USCIS asking this is not outrageous at all, in fact it's only common sense.

Nope there was no mention of the divorce decree, only the marriage license.I hope they dont do another one after I fix this. I will let you know what happens after I get it back to them.

Catt - I assumed being a marriage certificate that a translation wouldn't be just a random piece of paper that someone wrote on. If it's an official document translated by a company or something it should be verified.

zawjatsaid - Maybe you should consider talking to them about the divorce decree or sending it with the marriage certificate. Because I know if you have previously been married you have to prove that it's legally over. You may consider something to avoid having any more issues. Good luck!!

actually anyone CAN write the translation. but yes i thought as well that it would be assumed to be sent with a copy of the original. my marriage certificate is in spanish. i had to send them a copy of that. as well as the translatiion. because what good is a translation without the document that your translating

you send it to them yet? if yes, have they recieved it? hopefully after that you'll get your approval
